The Ministry of Finance: Has not yet developed a draft law on property being house and land

This is an affirmation from the Ministry of Finance on information related to the draft law on property being house and land. On March 14, this agency said that it is asking ministries, branches and localities to summarize and evaluate with current regulations related to land.

The Ministry of Finance affirmed: Currently, a draft law has not been developed to collect opinions of organizations and individuals before submitting to the Government, the National Assembly Standing Committee, and the National Assembly.

On December 16, 2021, the Prime Minister issued Decision No. 2114/QD-TTg promulgating the Plan to implement Conclusion 19-KL/TW of the Politburo and the Scheme on Orientation of the Law-making Program for the term of office. XV National Assembly. Accordingly, the Ministry of Finance assumes the prime responsibility for, and performs the following tasks: Research and review the Law on Tax on Non-Agricultural Land Use (FLA). The deadline for reporting to the Government is no later than September 30, 2022 and reporting to the National Assembly Standing Committee no later than December 30, 2022.

Currently, the Ministry of Finance is asking relevant ministries, branches, localities and organizations to summarize and assess the impact on the implementation of the Law on Land Use Tax and the Law on Land Use Tax (Dispatch No. 1779). /BTC-CST and number 1804/BTC-CST dated 24/2/2022).

In particular, the Ministry of Finance proposed ministries, branches and localities to send reviews and assessments to serve the correction of tax laws before April 15, 2022. Six tax laws are expected to be amended and supplemented, including: Law on Natural Resources Tax; Law on Environmental Protection Tax; Law on Tax on Agricultural Land Use; Law on Non-agricultural Land Use Tax; Personal income tax Law; Law on Export Tax and Import Tax.

On the basis of problems of ministries, branches, localities and international experience, the Ministry of Finance will review and evaluate the implementation process of the Law on Land Use Tax and the Law on Foreign Use Tax to propose solutions. measures to complete tax policies related to real estate to report to the competent authorities according to the schedule specified in Decision No. 2114/QD-TTg , ensuring compliance with Vietnam's socio-economic conditions , in line with international practices, ensuring the consistency of the tax policy system related to property and placing it in the overall reform of the tax policy system in the 2021-2030 period.

Previously, related to the field of land and real estate, in the Resolution of the special session on legal construction in January 2022, the Government assigned the Ministry of Construction to assume the prime responsibility and coordinate with relevant agencies. research and fully absorb opinions to perfect policies on real estate and housing business to develop the Law on Real Estate Business (amended) and the Law on Housing (amended). The Government also emphasized the requirement to organize consultation with ministries, branches, localities, experts, scientists, businesses and people in the process of drafting laws to ensure practicality, feasibility, create high consensus, do well the communication work before, during and after submitting to competent authorities for consideration and decision.
