Regarding this issue, LawNet would like to answer as follows:

1. What is the Gratitude Fund?

According to Article 173 of Decree 131/2021/ND-CP, Gratitude Fund means a fund established for the purpose of directly supporting people with meritorious services and relatives; supporting the construction, renovation, upgrading, and repair of works of martyrs; and supporting non-profit activities.

2. Authority to establish the Gratitude Fund in Vietnam

Article 179 of Decree 131/2021/ND-CP stipulates the authority to establish the Gratitude Fund in Vietnam as follows:

- The Prime Minister is responsible for establishing the Central Gratefulness Fund and the Central Gratefulness Fund Management Board.

The Central Gratefulness Fund Management Board includes:

+ The Minister of Labor, War Invalids, and Social Affairs shall act as the Head of the Committee;

+ Deputy Minister of Labor, War Invalids, and Social Affairs as the Standing Deputy Head of the Committee;

+ Representative of the Standing Committee of the Central Committee of the Vietnam Fatherland Front as Deputy Head of the Committee;

+ Leading representatives of the Central Vietnam Veterans Association, the Central Vietnam Women's Union, and the Vietnam General Confederation of Labor are members.

- The Presidents of the People's Committees of the province, district, and commune are responsible for establishing the Gratitude Fund and the Management Board of the Gratitude Fund at the same level.

+ The Provincial-level Gratitude Fund Management Board includes:

(i) Vice Chairman of the Provincial People's Committee as Head, Director of the Department of Labor, War Invalids, and Social Affairs as Standing Deputy Head

(ii) Representative of leaders of the Vietnam Fatherland Front Committee at the provincial level as Deputy Head

(iii) Representative of leaders of the Veterans Association, Women's Union, and Labor Confederation on the same level as members.

(i) The district-level Gratitude Fund Management Board includes:

(ii) The Vice Chairman of the District People's Committee shall act as the Head of the Committee, and the Head of the Division of Labor - Invalids, and Social Affairs at the district level shall act as the Standing Deputy Head of the Committee.

(iii) Representative of the leadership of the Vietnam Fatherland Front Committee at district level as Deputy Head

(iv) Representative of leaders of the Veterans Association, Women's Union, and Labor Union on the same level as members.

+ The Management Board of the Commune-level Gratitude Fund includes:

(i) Vice Chairman of the Commune People's Committee as Head, a commune-level cadre and civil servant in charge of culture - society, or labor - invalids, and social affairs as Standing Vice Chairman

(ii) The representative of the leadership of the Vietnam Fatherland Front Committee at the commune level is the Deputy Head of the Committee.

(iii) Representative of leaders of the Veterans Association and Women's Union at the same level as members.

- The head of the Management Board of the Gratefulness Fund at the central, provincial, and district levels is responsible for setting up an assisting department, which is the Office of the Gratitude Fund at the same level; the head of the Management Board of the Gratitude Fund at the commune level establishes the helping department of the Gratitude Fund at the commune level.

+ The Office of the Central Gratitude Fund is located at the Department of People with Meritorious Services, Ministry of Labor, War Invalids, and Social Affairs, which includes a number of part-time officials and civil servants of the Department of People with Meritorious Services.

+ The Provincial Office of Gratitude Fund is located at the Department of Labor - Invalids, and Social Affairs, which includes a number of part-time officials and civil servants of the Department of Labor - Invalids, and Social Affairs.

+ The District Office of Gratitude Fund is located at the Division of Labor - Invalids, and Social Affairs, which includes a number of part-time officials and civil servants of the Department of Labor - Invalids, and Social Affairs.

+ The assisting section of the Commune-level Gratitude Fund Management Board is located at the Office of the Commune-level People's Committee, consisting of a number of part-time officers of the Commune-level People's Committee. The accountant and treasurer of the Commune-level Gratitude Fund shall be held by the accountants and treasurers of the commune-level People's Committees.

3. Objects not required to contribute to the Gratitude Fund in Vietnam

Objects not required to contribute to the Gratitude Fund include:

- Persons under 18 years old and retired people.

- Subjects who are receiving subsidies and allowances according to the Ordinance.

- Persons with disabilities according to the provisions of the law on disabled people.

- People who are enjoying pensions, allowances for loss of working capacity, and social allowances.

- People who are studying at schools belonging to the national education system.

- Persons who have lost their civil capacity.
