Shorten the time for deposit refunds after revoking the license for provision of travel services in Vietnam

The Ministry of Culture, Sports and Tourism of Vietnam issued Circular 13/2021/TT-BVHTTDL amending and supplementing a number of articles of Circular 06/2017/TT-BVHTTDL elaborating a number of articles of the Law on Tourism.

Shorten the time for deposit refunds after the decision on revocation of the license for provision of travel services is published

According to the Circular, shortening the time for deposit refunds after the decision on revocation of the license for provision of travel services is published is regulated as follows:

Within the duration of 30 days from the day on which the decision on revocation of the license for provision of travel services is published on the web portal of the licensing authority and travel service provider management website, in case of no complaints and denunciations related to obligations towards tourists or tourism service providers, the licensing authority shall request banks to let the travel service provider to withdraw its deposits;

In case of complaints and denunciations related to obligations towards tourists or tourism service providers, the licensing authority shall cooperate with relevant competent authorities in taking actions in accordance with regulations of law;

Thus, compared to before, the time for deposit refund after revoking the travel service business license is shortened from 60 days (according to Circular 06/2017/TT-BVHTTDL) to 30 days.

In addition, Circular 13/2021 also shortens the time limit for the licensing agency to issue a decision on revocation of the travel service business license, specifically:

Within 5 business days from the day on which an inspection conclusion is issued by the competent authority, the licensing authority shall issue a decision on revocation of the license for provision of travel services.

The decision shall be issued to the provider, inspecting authority, immigration authority, tax authority and business registration authority of the province where the provider is headquartered, and published on the web portal of the licensing authority and travel service provider management website

Previously, the time limit for the licensing authority shall issue a decision on revocation of the license for provision of travel services was 15 days from the day on which an inspection conclusion is issued by the competent authority. Thus, Circular 13/2021/TT-BVHTTDL has shortened the time limit for revocation of the travel service business license compared to before.

Note: Circular 13/2021/TT-BVHTTDL takes effect from November 30, 2021. Agencies, units and enterprises providing travel services that are carrying out the procedures for refunding the deposit according to the provisions of Articles 6 and 7 of Circular 06/2017/TT-BVHTTDL may apply the time limit as prescribed in Circular 13/2021/TT-BVHTTDL for further settlement.
