Regarding this issue, LawNet would like to answer as follows:
1. Funding for implementing the Intellectual property asset development program by 2030 in Vietnam
According to Article 2 of Circular 75/2021/TT-BTC, iunding for implementing the Intellectual property asset development program by 2030 in Vietnam includes:
(1) Funding from state budget:
- Funding for science and technology career derived from central-government budget allocated for covering costs of performing science and technology tasks (projects, schemes and plans) and general activities and recurring tasks of the Program directly managed by the central government, including:
= National-level science and technology tasks of the Program (managed by the Ministry of Science and Technology), including:
== Tasks performed to fulfill the criteria of the national-level science and technology tasks as prescribed in the Law on Science and Technology and its guiding documents;
== Tasks performed in ethnic minority and mountainous regions, extremely disadvantaged areas, and typical, complicated or specialized tasks as defined by the Ministry of Science and Technology shall be given priority;
= Ministerial-level science and technology tasks of the Program (managed by Ministries or central-government authorities), including: Tasks of the Program which meet the criteria for ministerial-level science and technology tasks;
= General activities and recurring tasks of the Program managed by the central government.
- Funding from provincial-government budget:
= Funding for science and technology career derived from provincial-government budgets allocated for covering costs of performing the Program’s tasks managed by provincial governments; general activities and recurring tasks of the Program managed by the provincial governments; national-level tasks performed in the province (local resources may be mobilized, if necessary).
Funding for covering costs of protection registration, improvement of efficiency in management, operation and development of IP assets regarding collective trademarks, certification trademarks and geographical indications for local leading or specific products and products associated with OCOP (One Commune, One Product) Program shall be given priority;
= Funding derived from provincial-government budgets allocated for performing the Program’s tasks included in national target programs, national programs, and other social - economic development programs under the management of provincial governments so as to improve efficiency in protection, management, operation and development of IT assets for leading and specific products of provinces and of enterprises.
(2) Other funding sources, including:
- Funding provided by organizations, individuals and enterprises undertaking the Program’s tasks;
- Other lawfully mobilized funding sources.
2. Objectives of the Intellectual property asset development program by 2030 in Vietnam
* General objectives of the Intellectual property asset development program by 2030
Turning intellectual property into an important tool to improve national competitiveness, create an environment to encourage innovation, and promote economic, cultural, and social development.
* Specific objectives of the Intellectual property asset development program by 2030
- By 2025:
+ Intellectual property rights for scientific research results and innovation are propagated, raised awareness about, and supported in 100% of universities and research institutes;
+ At least 40% of products are recognized as national products, national key products, key products and services specific to provinces and centrally run cities, and products associated with the One Commune One Product Program (OCOP Program) are supported for protection registration, intellectual property management and development, origin control, and quality after protection.
- By 2030:
+ The number of patent applications filed by research institutes and universities grows at a rate of 16-18% per year, while applications for plant variety protection grow at a rate of 12-14%.
+ At least 60% of products are recognized as national products, national key products, key products and services specific to the province or centrally run city, and products associated with the OCOP Program are assisted in registering for protection, managing and developing intellectual property, and controlling the origin and quality after protection;
+ The number of trademark registration applications filed by Vietnamese businesses grows by 8-10% per year on average.
