Working overtime helps increase income for employees but affects their health, so Labor Code 2019 clearly stipulates the Requirements for enterprises to assign overtime in Vietnam.
According to Dispatch 1312/LDTBXH-ATLD dated April 26, 2022 of the Ministry of Labor, War Invalids and Social Affairs of Vietnam guiding the implementation of Resolution 17/2022/UBTVQH15 on the number of extra working hours in 01 year, in 01 month of employees in the context of COVID-19 epidemic, employers (or enterprises) may assign employees to work overtime for a maximum of 300 hours per year in the following cases:
Vietnam's General Confederation of Labor issued Dispatch 4359/TLD-QHLD dated June 16, 2022 on implementation instructions Resolution 17/2022/UBTVQH15. In particular, it is suggested that enterprises give employees at least 10 minutes of break after every 90 minutes of overtime.

The enterprise must make a notice on the organization of overtime when the number of overtime hours is from over 200 hours to 300 hours/year. The latest form of overtime notice for businesses is form number 02/PLIV issued at Decree 145/2020/ND-CP as follows.
