New regulation on appraisal fees for schemes for environmental rehabilitation and restoration to be applied as of March 20, 2023

On February 2, 2023, the Minister of Finance of Vietnam promulgated Circular No. 07/2023/TT-BTC on appraisal fees for schemes for environmental rehabilitation and restoration, collection, payment, management, and use thereof performed by central agencies.

According to the Circular, appraisal fees for schemes for environmental rehabilitation and restoration are calculated based on the total investment capital of projects as follows:

- If the total investment capital of the project is up to 10 billion VND: 6 million VND.

- If the total investment capital of the project is more than 10 - 20 billion VND: 9 million VND.

- If the total investment capital of the project is more than 20 - 50 billion VND: 15 million VND.

- If the total investment capital of the project is more than 50 - 100 billion VND: 27 million VND.

- If the total investment capital of the project is more than 100 - 200 billion VND: 30 million VND.

- If the total investment capital of the project is more than 200 - 500 billion VND: 39 million VND.

- If the total investment capital of the project is more than 500 - 1.000 billion VND: 44 million VND.

- If the total investment capital of the project is more than 1.000 - 1.500 billion VND: 48 million VND.

- If the total investment capital of the project is more than 1.500 - 2.000 billion VND: 49 million VND.

- If the total investment capital of the project is more than 2.000 - 3.000 billion VND: 51 million VND.

- If the total investment capital of the project is more than 3.000 - 5.000 billion VND: 53 million VND.

- If the total investment capital of the project is more than 5.000 - 7.000 billion VND: 56 million VND.

- If the total investment capital of the project is more than 7.000 billion VND: 61 million VND.

(Previously, Circular No. 35/2017/TT-BTC divides appraisal fees into 2 cases:

- Case I: The appraisal process is not performed by the same competent agency with a fee ranging from 6 - 61 million VND.

- Case II: The appraisal process is performed by the same competent agency with a fee ranging from 4 – 40,7 million VND.)

Circular No. 07/2023/TT-BTC comes into force as of March 20, 2023 and replaces Circular No. 35/2017/TT-BTC.
