New regulation of Vietnam on cases of suspension of water resource permits

On February 1, 2023, the Government of Vietnam promulgated Decree No.02/2023/ND-CP elaborating on the Law on Water Resources.

According to the Decree, a water resource permit shall have its validity suspended when the holder commits one of the following violations:

(1) Violate regulations in the permit, which causes pollution and/or exhaustion of water resources;

 (2) Perform underground water extraction that causes subsidence, deformation of works, saltwater intrusion, or serious exhaustion or pollution of water resources;

(3) Perform reservoir or dam operation that causes floods or artificial inundation, seriously affecting the production and daily life of people in the upstream and downstream areas of reservoirs and dams;

(4) Transfer the right to utilize water resources without the approval of competent agencies;

(5) Fail to fulfill financial obligations as per regulation;

(6) Use the permit for illegal activities.

Compared to Decree No. 201/2013/ND-CP, Decree No. 02/2023/ND-CP has added cases (2) and (3).

Decree No.02/2023/ND-CP, comes into force as of March 20, 2023 and annuls Decree No. 201/2013/ND-CP.
