On August 2, 2023, the Ministry of Public Security of Vietnam issued Decision 5358/QD-BCA on the announcement of newly issued administrative procedures in the field of immigration management.

1. Procedures for granting written permission to use ABTCs at ministries and branches in Vietnam

(1) Order of execution:

Step 1: Prepare documents according to the provisions of the law.

Step 2: Submit your application directly at a specialized agency of a ministry or branch or submit it online through the National Public Service Portal or the Public Service Portal.

- In case the dossier is not valid: the specialized agency of the ministry or branch is responsible for guiding the completion of the dossier according to form CV03 (issued together with Decision 09/2023/QD-TTg).

- In case the application is valid: specialized agencies of ministries and branches receive, process, consider, and submit to competent authorities for promulgation a written consent to allow businessmen to use ABTCs for eligible businessmen or a written reply in case of ineligibility.

Competent authorities consider and issue written consent to allow businessmen to use ABTCs; case of refusal must be notified in writing, clearly stating the reason.

Step 3: Get the result

Agencies, organizations, and businesses that apply for written permission to use ABTCs can register to receive results directly or online through the Public Service or through the Public Postal Service.

(2) Submission methods:

- Directly: submit dossiers and receive results directly at specialized agencies of ministries and branches.

If the application is submitted directly, the agency, organization, or enterprise may send a person to submit the application and receive the result on its behalf.

- Online: submit documents, receive online results through the National Public Service Portal or the Ministry and Sector Service Portal.

- Public postal service: receive results through the public postal service.

2. Procedures for granting written permission to use ABTCs locally in Vietnam

(1) Order of execution:

Step 1: Prepare documents according to the provisions of the law.

Step 2: Submit your application directly at a specialized agency of the People's Committee of the province or city directly under the central government, or submit it online through the National Public Service Portal or Public Service Portal of the People's Committee of the province or centrally run city.

- In case the dossier is not valid: the specialized agency of the People's Committee of the province or centrally run city is responsible for guiding the completion of the application according to Form CV03 (issued together with Decision 09/2023/QD-TTg).

- In case the application is valid: Specialized agencies of People's Committees of provinces and centrally run cities are responsible for receiving, processing, considering, and submitting to competent authorities for the issuance of written consents to allow businessmen to use ABTCs for eligible businessmen or a written reply in case of ineligibility.

Competent authorities consider and issue written consent to allow businessmen to use ABTCs; cases of refusal must be notified in writing, clearly stating the reason.
