07 Main Contents for Making Proposals and Organizing the Implementation of the Law Development Program

This is a notable content in Circular 79/2013/TT-BQP stipulating the functions, tasks, powers, organizational structure, and working relationships of legal organizations and legal officers in the Army.

According to Circular 79/2013/TT-BQP, seven contents are stipulated for the proposal and implementation of programs for building laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly (hereinafter collectively referred to as laws, ordinances); program for building decrees of the Government, decisions of the Prime Minister (hereinafter collectively referred to as decrees) by legal organizations and legal officers in the Army:

  1. Guide and urge the agencies and units under the Ministry of National Defense to prepare proposals for building laws, ordinances, and decrees in fields under the management scope of the Ministry of National Defense.

  2. Preside and cooperate with relevant agencies and units to draft proposals for building laws, ordinances, and decrees. If necessary, recommend the Minister organize meetings with relevant agencies and units with the participation of representatives from the Ministry of Justice, the Office of the Government, the Ministry of Finance, and the Ministry of Home Affairs to provide opinions on the proposals for building laws, ordinances, and decrees.

  3. Coordinate with relevant agencies and units to prepare the dossier proposing the construction of laws, ordinances, and decrees annually, submitting to the Minister to forward to the Ministry of Finance and the Ministry of Home Affairs to solicit opinions on the reasonableness of the projected financial and human resource sources.

  4. Coordinate with relevant agencies and units to amend and complete the dossier proposing the construction of laws and ordinances to submit to the Minister for review and decision to send to the Ministry of Justice; amend and complete the dossier proposing the construction of decrees, submitting to the Minister for review and decision to send to the Office of the Government and the Ministry of Justice to plan the program for building decrees of the Government.

  5. Develop a plan for implementing the program for constructing laws, ordinances, and decrees after approval.

  6. Summarize and draft proposals for adjusting and supplementing the program for constructing laws, and ordinances to submit to the Minister for review and decision to send to the Ministry of Justice; draft proposals for adjusting and supplementing the program for constructing decrees, submitting to the Minister for review and decision to send to the Ministry of Justice and the Office of the Government.

  7. Develop quarterly reports on the situation of implementing the program for constructing laws, ordinances, and decrees; construction progress and arising issues in the process of constructing legal normative documents, submitting to the Minister for review and decision to send to the Ministry of Justice, and the Office of the Government.
