06 Duties and Powers in the Work of Reviewing and Systematizing Legal Documents

Recently, the Ministry of National Defense has issued Circular 79/2013/TT-BQP stipulating the functions, duties, powers, organizational structure, and working relationships of the legal organization and legal officers in the Army.

According to Article 7 of Circular 79/2013/TT-BQP, the regulations regarding six missions and authorities in the work of reviewing and systematizing legal normative documents of legal organizations and legal officers in the Army are as follows:

  1. Preside over, cooperate with relevant agencies and units to develop plans for reviewing and systematizing legal normative documents and international treaties that Vietnam has joined or is a member, related to the sectors and fields under the Ministry's management scope, and monitor, expedite, and inspect the implementation.

  2. Organize the review and systematization of legal normative documents.

  3. Provide professional guidance in the work of reviewing and systematizing.

  4. Periodically, every six months, prepare a list of expired legal normative documents, a list of still effective legal normative documents that contain legal provisions needing amendment, supplementation, or abolition within the management scope of the Ministry, and report to the Minister for consideration and decision.

  5. Promptly submit to the Minister to suspend implementation, handle according to authority, or recommend a competent state agency to suspend the implementation and handle in accordance with the law against illegal official letters, announcements, telegraphs, guidelines, and other administrative documents or contrary to the regulations of the superior state agency.

  6. Summarize the results of reviewing and systematizing legal normative documents related to sectors and fields under the Ministry's management scope, propose solutions for handling conflicting, overlapping, illegal, or no longer appropriate legal provisions, submit to the Minister for consideration, and send to the Ministry of Justice.
