The article presents the cases in which the time participating in professional legal training for lawyers can be converted according to current legal regulations in Vietnam.
This is an important provision stipulated in Circular 02/2019/TT-BTP, which stipulates the obligation to participate in compulsory professional training for lawyers in Vietnam. This document replaces Circular 10/2014/TT-BTP.
Decree 82/2020/ND-CP of Vietnam's Government stipulating the sanctions for administrative violations in the fields of judicial support; judicial administration; marriage and family; civil judgment enforcement; bankruptcy of enterprises and cooperatives came into effect on September 1, 2020. This Decree has supplemented and significantly increased the sanctions for violations committed by lawyers in their practice.
Recently, the Ministry of Justice of Vietnam has issued Circular 17/2011/TT-BTP providing guidance on the provisions of the Law on Lawyers and the Decree guiding the Law on Lawyers concerning the socio-professional organization of lawyers.
On August 24, 2023, the Minister of Justice of Vietnam issued Circular 05/2023/TT-BTP on the list and periodic deadlines for changing working positions in fields under the management of the Ministry of Justice at local governments.
Recently, the Prime Minister of Vietnam has issued the Decision No. 34/2020/QĐ-TTg introducing classification list of occupations of Vietnam, effective from January 15, 2021. According to this Decree, the lawyer profession falls under the category of occupations that require in-depth expertise, corresponding to a university degree.
