In recent years, the problem of enterprises discharging toxic wastes into the environment still causes headaches for the authorities of Vietnam. Many businesses carry out projects with a scale of trillions but very modest investment in waste treatment systems. So, what sanctions does the law prescribe for enterprises' acts of discharging waste into the environment?
The Law on Environmental Protection 2014 of Vietnam was issued on June 23, 2014. This Law provides statutory provisions on environmental protection activities; measures and resources used for the purpose of environmental protection; rights, powers, duties and obligations of regulatory bodies, agencies, organizations, households and individuals who are tasked with the environmental protection task. Acts which are prohibited in environmental protection are also specified in this Law.
Environmental impact assessment refers to the analysis and prediction of environmental impacts of specific investment projects in order to take preventive measures to protect the environment during the implementation of such projects. How are Vietnam’s regulations on environmental impact assessment?
Environment refers to a system of natural and artificial physical factors affecting the existence and development of human beings and creatures. In view of this important role, Vietnam’s law has set out many specific regulations to ensure the sustainable development of the environment.
Environmental law is an important branch of law in the Vietnamese legal system. Since the birth of the Democratic Republic of Vietnam until now, along with the perfection of the legal system, environmental law has also been increasingly paid attention to, consolidated, developed and perfected.
Environmental protection is one of the top priorities of the Party and the State. Resolution No. 24-NQ/TW of June 03, 2013 of the 7th Conference of the 11th Central Committee of the Party clearly stated that: Actively responding to climate change, strengthening natural resources management and environmental protection are issues of special importance, with great impact, interrelated, and affecting each other, together determining the sustainable development of the country; is the basis and premise for planning economic and social development policies of Vietnam.
According to the Ministry of Natural Resources and Environment, the Law on Environmental Protection 2014 of Vietnam will officially take effect from January 01, 2015. Many contents have been specified in many points compared to the Law on Environmental Protection 2005.
