The Law on Administrative Procedures was approved by the 13th National Assembly of Vietnam at its 10th session on November 25, 2015 (Law on Administrative Procedures 2015) and effective from July 01, 2016.
The Law on Administrative Procedures 2015 of Vietnam was promulgated on November 25, 2015, regulating the order and procedures for instituting lawsuits, settling administrative cases, executing administrative judgments and settling complaints and denunciations in administrative procedures etc. Notably, this Law regulates rights and obligations of involved parties in administrative cases.
The Law on Administrative Procedures 2015 was approved on November 25, 2015 by the National Assembly of Vietnam and came into force from July 01, 2016. This Law has institutionalized the Party's principles, guidelines, and viewpoints regarding judicial reform, including expanding the jurisdiction of the courts in handling administrative disputes, strongly innovating the procedures for resolving administrative disputes in courts, and facilitating citizens to participate in litigation, ensuring equality between citizens and authorities before the courts.
According to Article 7 of the Law on Complaints 2011 of Vietnam, when having grounds to believe that an administrative decision or administrative act is unlawful or directly infringes upon his/her rights and lawful interests, a person may make a first-time complaint with the person who has issued such administrative decision or the agency that manages the person who has committed such administrative act, or institute an administrative lawsuit at court in accordance with the Law on Administrative Procedures.
