The Government has just issued Decision 40/2021/QD-TTg on the Overseas Employment Support Fund, according to which, from February 21, 2022, workers must return home before the time limit for support up to 20,000,000 copper.

Specifically, support levels for workers working abroad under contracts who must return home ahead of time from the Overseas Employment Support Fund are as follows:
(1) In case the employee has to return home ahead of time because the overseas employer is dissolved, bankrupt or has production downsizing due to natural disasters, epidemics, political instability, war, recession, etc. economic or other force majeure reasons:
Support level: from 7,000,000 VND to 20,000,000 VND/case (according to Article 11 of Decision 40/2021/QD-TTg ).
(2) In case the employee has to return home ahead of time due to a labor accident, accident, illness or disease to the extent that he is no longer able to continue working abroad:
Support level: from 10,000,000 VND to 30,000,000 VND/case (according to Article 10 of Decision 40/2021/QD-TTg ).
(Currently, the maximum support level is 5,000,000 VND/case)
(3) Where the employee has to return home before the time limit due to unilateral termination of the labor contract when the employer is abusive, forced to work or has a clear and direct threat to his/her life. , health or sexual harassment while working abroad:
Support level: from 7,000,000 VND to 20,000,000 VND/case (according to Article 12 of Decision 40/2021/QD-TTg ).
In addition, other support levels for employees working abroad under contracts from the Overseas Employment Support Fund are as follows:
(4) Support to settle disputes arising from employees in the activities of sending workers to work abroad under contracts (according to Article 13 of Decision 40/2021 )
- Support employees with costs of hiring lawyers, legal advice, court fees to settle cases:
The support level is equal to 50% of the cost of hiring a lawyer, legal advice, and legal fees, but maximum VND 50,000,000/case; In case the case involves many employees, the maximum support level is 100,000,000 VND/case.
- Support to rent temporary accommodation for employees according to the decision of a competent authority during the settlement of labor contract disputes with the employer but the employee is not arranged with accommodation:
The level of support is equal to 100% of actual costs according to invoices and documents of renting accommodation for employees.
(5) Supporting relatives of employees who die or go missing while working abroad (according to Article 14 of Decision 40/2021 )
Support level: 40,000,000 VND/case.
(Currently, the level of support for relatives of workers who die while working abroad is 10,000,000 VND/case).
(6) Support vocational training for employees (according to Article 15 of Decision 40/2021 )
Workers must return home before the due date in the following cases (1), (2), (3) have the need to be trained for job change, and are supported with training costs to improve vocational skills to participate. labor market, stable life as follows:
Support level 1,000,000 VND/month, maximum 06 months/person/course.
Decision 40/2021/QD-TTg takes effect from February 21, 2022 and replaces Decision 144/2007/QD-TTg .
