What are number of day offs are officials, public employees, and employees in Vietnam entitled to for Tet holiday?

There are only 4 months left until Lunar New Year 2021 arrives, everyone is excited to celebrate a full Tet after the recent Covid-19 pandemic. Below is the Tet holiday schedule for 2021 for officials, public employees, and employees in Vietnam.

According to Article 112 of the Labor Code 2019 (effective from January 1, 2021), employees in Vietnam are entitled to a 5-day leave with full pay during the Lunar New Year holiday.

Notably, Clause 3, Article 112 of the Labor Code 2019 also stipulates that annually, based on actual conditions, the Prime Minister of the Government of Vietnam will decide specific days for the Lunar New Year holiday.

Therefore, the 2021 Lunar New Year holiday period for employees will be determined according to the decision of the Prime Minister of the Government of Vietnam, not by the employers as before.

Currently, the Ministry of Labor, Invalids, and Social Affairs has proposed 2 options for the 2021 Lunar New Year holiday for officials and public employees and employees to the Prime Minister for consideration and decision, specifically:

For officials and public employees, employees in administrative agencies, non-business units, political organizations, social-political organizations in Vietnam

Option 1: The 2021 Lunar New Year holiday is 7 consecutive days, from February 10, 2021, to February 16, 2021 (from December 29, Year of the Rat to January 5, Year of the Ox).

Option 2 for the 2021 Lunar New Year holiday for Vietnamese officials and public employees and employees

For employees

Based on actual conditions and the holiday schedule for officials and public employees, employees of administrative agencies, non-business units, political organizations, and social-political organizations, employers will arrange the 2021 Lunar New Year holiday schedule for employees, specifically:

- Choose 1 day at the end of the year and 4 days at the beginning of the Lunar New Year, or 2 days at the end of the year and 3 days at the beginning of the Lunar New Year.

- Companies, agencies, and units need to notify the 2021 Lunar New Year holiday plan to employees at least 30 days before its implementation.

As soon as the official Decision on the 2021 Lunar New Year holiday is issued, the editorial board of Thu Ky Luat will update our esteemed customers and members.
