This is a notable content prescribed at the Decree No. 136/2020/NĐ-CP providing guidelines for a number of articles of law on fire prevention and fighting and law on amendments to law on fire prevention and fighting.
Pursuant to Clause 3 Article 34 of the Decree No. 136/2020/NĐ-CP of the Government of Vietnam:
Leaders and vice leaders of internal and specialized firefighting forces operating on a part-time basis are entitled to full wages and other allowances (if any) and regular remuneration from their managing bodies. Based on the actual situation, heads of their managing bodies shall decide the benefit rate for each title, which shall be no lower than 20% of the region-based minimum wage.
Compared to old provision prescribed at Clause 3 Article 35 of the Decree No. 79/2014/NĐ-CP, leaders or Vice leaders of a part-time intramural firefighting team shall receive a support provided that it is not lower than 0.3 of the region-based minimum wage.
Currently, the statutory pay rate and region-based minimum wages are applied according to the Decree No. 38/2019/NĐ-CP and Decree No. 90/2019/NĐ-CP, specifically as following:
Statutory pay rate: VND 1,490,000 per month
Region-based minimum wages:
- Region I: VND 4,420,000/month.
- Region II: VND 3,920,000/month.
- Region III: VND 3,430,000/month.
- Region IV: VND 3,070,000/month.
Thus, in accordance with Decree No. 79/2014/NĐ-CP, the support allowance for leaders or Vice leaders of a part-time intramural firefighting team shall be no lower than VND 447,000/month (0.3 basic salary).
However, this provision is replaced by the Decree No. 136/2020/NĐ-CP of the Government of Vietnam. Thus from January 10, 2021, the support allowance for leaders or Vice leaders of a part-time intramural firefighting team shall be no lower than the following amounts (0.2 of the region-based minimum wage):
- Region I: VND 884,000/month.
- Region II: VND 784,000/month.
- Region III: VND 686,000/month.
- Region IV: VND 614,000/month.
