Vietnam: Retirement age of employees in 2022

According to Labor Code 2019, the retirement age of employees under normal working conditions is 60 years and 03 months for male employees and 55 years and 04 months for female employees. After that, each year increases by 03 months for male employees and 04 months for female employees. Thus, the retirement age of employees in 2022 will increase compared to 2021, specifically as follows:

Retirement age of employees under normal working conditions in Vietnam

Compared to the retirement age in 2021, the retirement age in 2022 will be adjusted to increase by 03 months for male employees and by 04 months for female employees.

Thus, the retirement age in 2022 for employees under normal working conditions is 60 years and 6 months for men and 55 years and 8 months for women.

Note:

- Retirement time is the end of the last day of the month of full retirement age according to regulations.

In case the employee continues to work after reaching the prescribed retirement age, the time of retirement is the time of termination of the labor contract.

- The time when the employee receives pension is the 1 day of the month immediately following the time of retirement.

Employees may retire at an earlier age under normal working conditions in Vietnam

According to Article 5 of Decree 135/2020/ND-CP and Clause 3, Article 169 of the Labor Code 2019:

Employees with reduced working ability; doing extremely heavy, toxic, or dangerous occupations and jobs; doing heavy, toxic, and dangerous occupations and jobs; Working in areas with extremely difficult socio-economic conditions, they can retire at an earlier age, but not more than 5 years old, compared to the retirement age under normal working conditions at the time of retirement, unless otherwise prescribed. Specifically:

- Employees who have worked for 15 years or more in occupations or jobs that are heavy, toxic, dangerous, or particularly heavy, toxic, or dangerous on the list issued by the Ministry of Labor, War Invalids, and Social Affairs .

- Employees who have worked for 15 years or more in areas with extremely difficult socio-economic conditions, including working time in places with a regional allowance coefficient of 0.7 or more before January 1, 2021.

- Employees whose working capacity is reduced by 61% or more.

- Employees who have worked in a profession or job that is heavy, toxic, dangerous, or particularly heavy, toxic, or dangerous for 15 years or more and have worked in areas with poor economic conditions. - Extremely difficult society for 15 years or more.

In this case, the lowest retirement age for employees in 2022 is 55 years and 6 months for men and 50 years and 8 months for women. Corresponding to the month and year of birth are as follows:

Retirement at an age higher than the retirement age under normal working conditions in Vietnam

Employees with high professional and technical qualifications can, in some special cases, retire at a higher age, but not more than 5 years, compared to the retirement age under normal working conditions at the time of retirement. specifically:

Employees can retire at a higher age when they agree with the employer to continue working after retirement age under normal working conditions.
