Vietnam: New forms used for enterprises using foreign workers of the Decree No. 152/2020/NĐ-CP

Recently, the Government of Vietnam has issued the Decree No. 152/2020/NĐ-CP on foreign workers working in Vietnam and recruitment and management of Vietnamese workers working for foreign employers in Vietnam. This Decree has issued new forms used for enterprises using foreign workers.

Specifically, the Decree No. 152/2020/NĐ-CP of the Vietnam’s Government effective from February 15, 2021 will completely annul Decree No. 11/2016/NĐ-CP dated February 03, 2016, Decree No. 140/2018/NĐ-CP dated October 08, 2018 and Decree No. 75/2014/NĐ-CP dated July 28, 2014. Appendix I and Appendix II issued together with the Decree No. 152/2020/NĐ-CP include the following new forms used for enterprises using foreign workers:

Form No. 03/PLI	Approval of job positions using foreign workers
Form No. 04/PLI	Request for the recruitment of Vietnamese workers to the job positions expected for foreign workers
Form No. 05/PLI	Request for change or increase the declared number of workers
Form No. 06/PLI	Recruitment of foreign workers holding the job positions for which Vietnamese workers are underqualified
Form No. 07/PLI	Report on employment of foreign workers
Form No. 08/PLI	Report on foreign workers
Form No. 09/PLI	Confirmation of exemption from work permit
Form No. 10/PLI	Certification of exemption from work permit
Form No. 11/PLI	Issuance/re-issuance/renewal of work permit for foreign workers
Form No. 12/PLI	Work permit
Form No. 13/PLI	Decision on revocation of work permit
Form No. 14/PLI	Logbook of foreign worker
Form No. 15/PLI	Rejection of exemption from work permit; issuance, re-issuance, renewal of work permit
Form No. 01/PLII	Application for job
Form No. 02/PLII	Report on recruitment and employment of Vietnamese workers
Form No. 03/PLII	Report on recruitment and employment of Vietnamese workers working for foreign employers
Form No. 04/PLII	Report on supply or outsourcing of Vietnamese workers working for foreign employers
