Upcoming: More Retired Teachers to Receive Additional Allowances

This is one of the notable contents in the Draft Decree to replace Decision 52/2013/QD-TTg, which regulates subsidy policies for retired educators who have not yet received seniority allowances in their pensions, and which is currently in the period for public consultation.

This draft has added more subjects eligible for allowance policies for retired teachers who have not received seniority allowances in their pensions compared to the current regulation in Decision 52/2013/QD-TTg. Specifically, the subjects eligible for additional allowances from the effective date of this Decree include:

  1. Retired teachers (including principals, vice principals of kindergartens, teachers, lecturers; teachers appointed by competent authorities to perform management tasks at educational institutions) who were directly teaching, educating at public educational institutions and academies, schools, centers tasked with training under state agencies, political organizations, socio-political organizations, or teaching, guiding practice at school workshops, stations, farms, laboratories, training ships of vocational education institutions and public universities. (These subjects were previously regulated in Decision 52 and are now continued in the Draft Decree).

  2. Retired teachers who were directly teaching, educating at semi-public educational institutions but were previously transferred from public educational institutions or were working at public educational institutions and those public educational institutions were converted to semi-public educational institutions by competent authorities and were paid according to the salary scale for public employees in the education sector. (This is a newly added subject in the Draft).

  3. Retired teachers who were teaching, educating at public educational institutions appointed by competent authorities as educational experts abroad, and upon returning from the expert mission, they retired immediately.* (This is a newly added subject in the Draft).*

  4. Retired teachers who participated in teaching at classes organized by youth volunteer units or other armed units but have not received state policies and benefits for youth volunteers or armed forces. (This is a newly added subject in the Draft).

  5. Teachers with periods as soldiers, police officers, cipher workers, later transferred to teaching at public educational institutions who, upon retirement as teachers, receive pensions with armed force seniority allowances but do not have teacher seniority allowances. (This is also a newly added subject in the Draft).

Thus, if this content in the Draft Decree is approved, from the effective date of this Decree, more retired teachers will receive additional allowances.

According to this Draft, the one-time allowance amount for the above subjects is calculated as follows:

Allowance Amount = (monthly pension x 10%) x number of years eligible for allowance

In which:

- Monthly pension is the pension amount in the month being received at the time this Decree takes effect.- Number of years eligible for allowance is the total period of direct teaching, educating, guiding practice in educational institutions and the period of teaching participation in youth volunteer forces counted for pension benefits (if not continuous, it will be cumulatively calculated), excluding time counted for armed forces seniority allowances in the pension.- If there are odd months from 3 to 6 months, it is rounded to half a year; from over 6 months to less than 12 months, it is rounded to 1 year.

Note: In case teachers eligible for allowances under this Decree but have not yet been settled and died from January 01, 2012 onward, one of the following relatives in order of priority will receive the allowance policies: spouse; biological or adopted children; biological or adopted parents; or legal guardians.

The basis for calculating the allowance for the relatives of the deceased teacher is the pension amount the teacher was receiving in the month before the death.
