To provide guidance on the regulations adjusting the retirement age for employees under the Labor Code, Hanoi has issued Decree 135/2020/ND-CP, which will officially take effect in Vietnam from January 01, 2021.

In the case where employees retire early according to the provisions of clause 3, Article 169 of the Labor Code 2019, the retirement age and the time of receiving pensions in Vietnam are determined according to the table below:

60 years old

The month immediately following the month the employee turns 60 years old

Employees are eligible for early retirement in Vietnam if they fall into one of the four following cases:

Case 1: The employee has at least 15 years working in a heavy, hazardous, dangerous, or especially heavy, hazardous, dangerous job or occupation as listed by the Ministry of Labor, Invalids, and Social Affairs (Hanoi, Vietnam).

Case 2: The employee has at least 15 years working in areas with particularly difficult socio-economic conditions, including the time worked in areas with a regional allowance coefficient of 0.7 or higher before January 1, 2021.

Case 3: The employee has a reduction in working capacity of 61% or more.

Case 4: The employee has a combined total of at least 15 years working in the occupations and jobs listed in Case 1 and the areas listed in Case 2.

Note: Employees are allowed to retire at a lower age but no more than 05 years younger than the retirement age in normal working conditions.
