Draft Decree Providing Detailed Regulations on Certain Provisions of the Labor Code Concerning Working Hours and Rest Periods is currently in the public commentary phase, expected to take effect from January 1, 2021.

The Draft Decree specifically stipulates the working hours to be considered as paid working hours for employees, including:
- Break time counted as working time when working in continuous shifts as specified in Clause 2, Article 9 of the Draft;- Breaks according to the nature of the work;- Necessary breaks during the labor process, accounted for in the labor norms for the natural physiological needs of humans;- Daily 60-minute break for female employees nursing children under 12 months old;- Daily 30-minute break for female employees during menstruation;- Time spent stopping work not due to the fault of the employee;- Time for occupational safety and hygiene training;- Time for meetings, study, and training required by the employer or agreed upon by the employer;- Time for meetings, study, and training summoned by the superior trade union for non-professional trade union officials according to the law on trade unions;- Time for health examinations and occupational disease detection organized by the employer according to the law.
Note: These regulations apply to officials and public employees, members of the people's armed forces, police officers, except where related legal documents specific to these groups have different provisions.
