When implementing the adjustment of the statutory pay rate under Decree 47/2017/ND-CP for officials, public employees, and workers, it is necessary to pay attention to determining the financial requirements for the adjustment and the number of staff positions.
Demand for budget adjustment for salaries depends on the actual number of employees
The total number of officials and public employees and workers to determine the demand for funds for adjusting the statutory pay rate is the actual number present as of July 01, 2017, but does not exceed the total number of staff granted by the competent authority (or approved) in 2017;
For the number of subjects exceeding the total number of staff granted by the competent authority at the reporting time, the agency or unit must ensure by itself the need for funds for adjusting the statutory pay rate for these subjects from the financial sources as prescribed by law; they are not to be included in the overall demand for adjusting the statutory pay rate in 2017 of the ministries, Central agencies, and centrally affiliated provinces and cities.
Basis for determining the total number of employees
The determination of the total number of employees granted by the competent authority is based on the following bases:
For employees of Ministries, Central agencies:
- Staff in the National Assembly, Supreme People’s Court, Supreme People’s Procuracy, State Audit: According to the Resolution of the Standing Committee of the National Assembly;- Staff of the Office of the President: According to the Decision of the President;- Staff in the Central Communist Party agencies, political-social organizations: According to the announcement of the Central Organizing Committee;- Staff of the Ministry of Defense, Ministry of Public Security: According to the decision of the competent authority;- State administrative staff, public service providers partly self-financed and public service providers fully financed by the State of Ministries, other Central agencies: According to the allocation decision of the Ministry of Home Affairs.
For employees of provinces and centrally affiliated cities:
- State administrative staff: According to the allocation decision of the Ministry of Home Affairs;- Career staff: As approved by the Provincial People’s Council in accordance with legal regulations;- Staff of local Communist Party agencies, political-social organizations: According to the announcement of the Central Organizing Committee;- Specialized staff and officials at the commune level determined within the staffing scope: According to the provisions of Clause 1, Article 4 of Decree 92/2009/ND-CP.
Units self-ensuring the budget for adjusting salaries for contract workers
For the number of people working under labor contract policies, only the beneficiaries of salaries from the State budget within the People's Army and People's Public Security within the staffing scope granted by the competent authority are summarized. Agencies or units shall self-ensure the demand for funds for adjusting the statutory pay rate for those working under labor contract policies as prescribed in Clause 4, Article 2 of Decree 47/2017/ND-CP from the allocated State Budget and other lawful revenues, without summarizing into the overall demand for adjusting the statutory pay rate in 2017 of the ministries, Central agencies, and centrally-affiliated provinces and cities.
Basis for determining the demand for funds to implement salary adjustments
The demand for funds to implement the adjustment of the statutory pay rate according to Decree 47/2017/ND-CP for the beneficiaries is based on:
- The amount of statutory pay rate increased;- Salary coefficients according to rank, grade, position;- Salary allowance coefficients according to policy regulations (excluding night work, overtime, and allowances specified in absolute amounts), the rate of contributions according to policy regulations (such as social insurance, unemployment insurance, health insurance, trade union fees).
The additional fund demand due to salary adjustment to implement the following policies:
- Payment of health insurance for relatives of officers, non-commissioned officers, soldiers in the armed forces of the Ministry of Defense, the Ministry of Public Security; payment of health insurance for relatives of those working in the cipher field;- Responsibility allowance regime for party committee members at all levels according to Regulation 169-QD/TW dated June 24, 2008, by the Secretariat; monthly support policy for activities of the party committee at the provincial level according to Regulation 3115-QD/TW dated August 04, 2009, by the Office of the Central Communist Party.- Operation costs of People's Council deputies at all levels;- Support allowance fund for non-officials in communes, wards, commune-level towns, hamlets, and residential groups according to the fixed rate from the central budget (including additional funds to implement social insurance policies for non-officials at the commune level).
For retired commune officials
The demand for funds to implement the increased allowance for retired commune officials is determined based on the number of actual beneficiaries as of July 01, 2017, the increased allowance level stipulated in Article 2 Decree 76/2017/ND-CP and the guidance of the Ministry of Home Affairs.
