This is one of the new procedures replaced at Decision 222/QD-BHXH on the announcement of replaced and abolished administrative procedures under the jurisdiction of Vietnam Social Insurance, taking effect on February 25, 2021.
Procedures for receiving pensions and monthly benefits for commune officials in Vietnam (Internet image)
Specifically, according to Decision 222/QD-BHXH, from February 25, 2021, procedures for receiving pensions and monthly benefits for commune officials in Vietnam will be implemented as follows:
(1) Documents and implementation order
Step 1: Prepare and submit application
*** Employees who are paying social insurance: prepare a dossier including the following documents and submit it to the employer. The employer receives, prepares, and submits documents according to regulations to the social insurance agency where the unit pays social insurance:
- Social insurance book.
- Decision to leave work to enjoy retirement benefits according to the form issued with Decree 46/2010/ND-CP or the original decision to leave work to enjoy retirement benefits (form No. 12-HSB) or Document terminating the labor contract to enjoy retirement benefits.
Decision on retirement benefits (form No. 12-HSB)
- Original copy of the Minutes of assessment of the level of reduction in labor skills of the Council of Medical Directors (in case the employee already has a medical examination record to enjoy other policies before and is eligible to enjoy them, they can be replaced with a copy) for those retiring due to reduced work skills or a copy of the Certificate of HIV/AIDS infection due to occupational accidents (equivalent to a decrease in work skills of 61%) for people infected with HIV/AIDS due to occupational accidents.
- Original personal declaration on time and area of service in the Army with regional allowance (Form No. 04B-HBQP issued with Circular 136/2020/TT-BQP dated October 29, 2020) for people who served in the Army before January 1, 2007 in areas receiving regional allowances, but the social insurance book does not show complete information as a basis for calculating regional allowances.
Personal declaration on time and area of service in the Army with regional allowance (Form No. 04B-HBQP))
*** People participating in voluntary social insurance, people reserving the time to pay social insurance: Prepare a dossier including the following documents and submit it to the social insurance agency of residence:
- Social insurance book.
- Original application form (Form No. 14-HSB).
Application for one-time social insurance benefits (Form No. 14-HSB)
- Original copy of the minutes of assessment of the level of reduction in labor skills of the Council of Medical Directors (in case the employee already has a medical examination record to enjoy other policies before and is eligible to enjoy them, they can be replaced with a copy) for those retiring due to reduced work skills or a copy of the Certificate of HIV/AIDS infection due to occupational accidents (equivalent to a decrease in work skills of 61%) for people infected with HIV/AIDS due to occupational accidents.
- In case you are serving a sentence and the prison sentence begins from January 1, 2016 onwards, an original copy of the Power of Attorney (form No. 13-HSB) is required.
- In case you have completed serving your prison sentence from January 1, 1995, to before January 1, 2016, you must have an additional copy of one of the following documents: Certificate of completion of prison sentence, Certificate of early release from prison, or Decision on exemption or postponement of prison sentence.
- In case of illegal exit and return, there must be a copy of the document from the competent state agency on returning to the country of legal settlement.
- In case of returning a missing person, there is an additional copy of the Court's legally effective decision to annul the decision declaring her missing.
- Original personal declaration on time and area of service in the Army with regional allowance (Form No. 04B-HBQP issued with Circular 136/2020/TT-BQP dated October 29, 2020) for people who served in the Army before January 1, 2007 in areas receiving regional allowances, but the social insurance book does not show complete information as a basis for calculating regional allowances.
- Invoices and documents for the collection of assessment fees, accompanied by a list of the contents of the facility performing the medical examination (in case of payment of medical examination fees).
*** Employees with a Decision or Certificate awaiting age eligibility to receive pension or monthly benefits according to Decree 09/1998/ND-CP: Prepare a dossier including the following documents and submit it to the social insurance agency of your place of residence:
- Original Decision or original Certificate of waiting for age eligibility to receive pension or waiting for monthly benefits according to Decree 09/1998/ND-CP; in case the above documents are lost, an original application form (form No. 14-HSB) stating the reason for the loss must be provided.
- Original copy of the minutes of assessment of the level of reduction in labor skills of the Council of Medical Directors (in case the employee already has a medical examination record to enjoy other policies before and is eligible to enjoy them, they can be replaced with a copy) for those retiring due to reduced work skills or a copy of the Certificate of HIV/AIDS infection due to occupational accidents (equivalent to a decrease in work skills of 61%) for people infected with HIV/AIDS due to occupational accidents.

Step 2: The social insurance agency receives the application and resolves it according to regulations.
Step 3: Get results
*** Employment unit: receives settlement results from the social insurance agency to pay employees participating in compulsory social insurance at the employment unit including: Decision on monthly retirement benefits. Social insurance payment process; notice of monthly pension/benefit payment; health insurance card.
*** Employees receive settlement results from the labor unit; or from the social insurance agency according to regulations; they also receive pensions and monthly benefits.
(2) Procedure to carry out
*** Submit:
Labor unit, voluntary social insurance participants, people reserving social insurance payment time, people waiting to meet age requirements to receive a pension, or people waiting to receive monthly benefits according to Decree 09/1998/ND-CP, submit an application in one of the following forms:
- Through electronic transactions.
+ Employer unit: prepare electronic records, digitally sign, and send to the Vietnam Social Insurance Electronic Information Portal or via the I-VAN Organization; in case you cannot convert paper documents to electronic format, send paper documents to the social insurance agency via the public postal service.
+ Individual registers to receive an authentication code and sends electronic documents to the Vietnam Social Insurance Electronic Information Portal or via the I-VAN Organization (if registered to use the I-VAN service); In case of not converting paper documents to electronic format, send paper documents to the social insurance agency via public postal service.
- Through the public postal service.
- Directly at the social insurance agency.
*** Get results
Employees receive dossiers from the employer or directly at the social insurance agency, through public postal services, or through electronic transactions, and receive pensions and benefits in one of the following forms:
- Through personal account.
- Through the public postal service.
- In case of authorizing another person to receive payment on behalf of you, follow the provisions of the procedure for "authorizing payment on behalf of social insurance and unemployment benefits" or the original authorization contract according to the provisions of law.
Employer unit: receives settlement results to pay employees participating in compulsory social insurance at the employer unit in one of the following forms: electronic transaction, public postal service, directly at the social insurance agency.
(3) Number of documents: 01 set
Note: In case the application does not clearly state the original, a valid copy can be submitted.
(4) Processing time: Maximum 12 working days from the date the social insurance agency receives complete documents according to regulations.
