Officially: Increase the retirement age in Vietnam according to the roadmap by years from 2021

Recently, the Government of Vietnam has issued the Decree No. 135/2020/NĐ-CP on retirement age, effective from January 01, 2021.

According to Article 3 of the Decree No. 135/2020/NĐ-CP of Vietnam’s Government, retirement date is the last day of the month in which one reaches the full retirement age as prescribed. If an employee continues in employment after his full retirement age as prescribed, the retirement date is the date of termination of employment.

Note: The start date for retirement benefits is the first day of the month following the month of the retirement date. If the employee's dossier does not indicate his day and month of birth, but year of birth only, January 1 of his year of birth shall be used as the basis for determining the retirement date and start date for retirement benefits.

Notably, according to Article 4 of the Decree No. 135/2020/NĐ-CP detailing Clause 2 Article 169 of the Labor Code 2019 of Vietnam (effective from January 01, 2021), since January 01, 2021, the retirement age of employees under ordinary working conditions are 60 years 3 months for male employees and 55 years 4 months for female employees; and the age increases by 3 months for male employees each successive year until he reaches 62 in 2028 and increases by 4 months for female employees each successive year until she reaches 60 in 2035.

Thus, officially from 2021, the retirement age is 60 years 3 months for male employees (increased by 3 months compared to provision of the Labor Code 2012) and 55 years 4 months for female employees (increased by 4 months compared to provision of the Labor Code 2012). However, this age will gradually increase according to the roadmap to 2028 and 2035.

The roadmap to adjust the retirement ages of employees to 2028 and 2035 for both males and females shall be done as follows:

Thus, officially from 2028 onwards, the retirement age is 62 years for male employees, and from 2035 onwards, the retirement age is 60 years for female employees.
