Pursuant to the Labor Code 2019 of Vietnam, an employment contract is an agreement between an employee and an employer on a paid job, salary, working conditions, and the rights and obligations of each party in the labor relations. Before recruiting an employee, the employer shall enter into an employment contract with such employee.
According to Article 20 of the Labor Code 2019 of Vietnam, an employment contract shall be concluded in one of the following types:
- An indefinite-term employment contract is a contract in which the two parties neither fix the term nor the time of termination of the contract;
- A fixed-term employment contract is a contract in which the two parties fix the term of the contract for a duration of up to 36 months from the date of its conclusion.
Concurrently, an employment contract shall have the following major contents:
1. The employer’s name, address; full name and position of the person who concludes the contract on the employer’s side;
2. Full name, date of birth, gender, residence, identity card number or passport number of the person who concludes the contract on the employee’s side;
3. The job and workplace;
4. Duration of the employment contract;
5. Job- or position-based salary, form of salary payment, due date for payment of salary, allowances and other additional payments;
6. Regimes for promotion and pay rise;
7. Working hours, rest periods;
8. Personal protective equipment for the employee;
9. Social insurance, health insurance and unemployment insurance;
10. Basic training and advanced training, occupational skill development.
Thus, according to the above provisions, in order to help Customers and Members save time in drafting labor contracts, LAWNET would like to send to Customers and Members files to download the latest form of labor contract according to the Labor Code 2019 as follows:

Besides, it should be noted that within 30 days after signing a labor contract or working contract with an employee or after recruiting an employee, the employer shall submit a registration dossier for first-time participation in social insurance to the social insurance agency (according to Point a Clause 1 Article 99 of the Law on Social Insurance of Vietnam). Concurrently, before every 3rd of a month, the employer shall send a notification of changes in working employees (if any, of the previous solar month) to the employment service center where its headquarters is located using the form No. 29 (according to Article 16 of the Circular No. 28/2015/TT-BLĐTBXH).
