The employee is entitled to advance wages under conditions agreed upon by both parties and will not be charged interest upon repayment. The maximum wage advance may not exceed 03 months' wages of the employee. Currently, the 2012 Labor Code does not specify this maximum advance.
The Draft also continues to maintain the provisions of the 2012 Labor Code. Specifically, the employer must advance wages corresponding to the number of days the employee temporarily takes off to fulfill civic obligations for 01 week or more but not exceeding 01 month’s wages and must recover the advanced amount.
Additionally, during annual leave, the employee is entitled to advance a minimum amount equal to the wages of the leave days.
Moreover, the Draft also supplements regulations concerning wage increase for employees. Accordingly, wage increases are to be agreed upon in the labor contract, collective bargaining agreement, or the employer's regulations.
