The Prime Minister of Vietnam has just promulgated Decision 28/2021/QD-TTg to implement Resolution 116/NQ-CP on policies to support employees and employers affected by COVID-19 from the Fund unemployment insurance. According to this Resolution, the documents and procedures for employees to receive support money are guided as follows:

**For employees who are participating in unemployment insurance
- The social insurance agency compiles a list of employees participating in unemployment insurance according to Form No. 01 and sends it to the employer.

No later than the end of October 20, 2021, the social insurance agency completes sending the list to all employers and publicizes the list of supported employees on the website of the social insurance agency
- Within 05 working days from the date of receipt of the list sent by the social insurance agency, the employer shall publicize the list of employees eligible for support so that the employee knows, for projection, additional information (if any); make and send a list of employees with correct and sufficient information and employees who voluntarily do not receive support according to Form No. 02 to the social insurance agency.

The employer shall make a list of information of the employee that needs to be adjusted according to Form No. 03 (if any), send it to the social insurance agency, enclosed with a document proving the adjusted information in accordance with the law of Vietnam, no later than November 10, 2021.

- Within 10 working days from the date of receipt of the correct and complete list of employees and within 20 days from the date of receiving the list of employees with adjusted information sent by the employer, the social insurance agency shall pay support to the employees. Encourage payment through employees' bank accounts.
In case of non-payment of support, the social insurance agency shall notify in writing and clearly state the reason.
** For employees who have stopped participating in unemployment insurance
- The employee requests the social insurance agency of the province or district where the employee needs to receive support according to Form No. 04.

The deadline for receiving support requests is no later than December 20, 2021 .
- Within 10 working days from the date of receipt of the employee's request for support, the social insurance agency shall pay the support payment to the employee, the time for completion is no later than December 31, 2021. Encourage payment through employees' bank accounts.
In case of non-payment of support, the social insurance agency shall notify in writing and clearly state the reason.

Conditions for receiving support in Vietnam (1) The employee is participating in unemployment insurance as of September 30, 2021 (named on the list of participating in unemployment insurance of the social insurance agency), excluding the following cases: - Employees working at state agencies, political organizations, socio-political organizations, units - Employees who are working at public non-business units whose recurrent expenditures are guaranteed by the state budget under Decree 60/2021/ND-CP of Vietnam stipulating the financial autonomy mechanism of non-business units. and the current legal regulations on financial autonomy of public non-business units. (2) Employees who have stopped participating in unemployment insurance due to the termination of their labor contracts or working contracts in the period from January 1, 2020 to the end of September 30, 2021 have a period of premium payment. Unemployment insurance is reserved according to the provisions of the law on employment, excluding those who have already decided to receive monthly pension. (Note: Not applicable to those who voluntarily do not receive support). Basis for calculation of the amount of support: Based on the time of paying unemployment insurance premiums of employees as of September 30, 2021 but not yet calculating unemployment benefits. In case an employee has submitted a dossier of application for unemployment benefits but there is no decision to receive unemployment allowance until September 30, 2021 , the total period of unearned unemployment insurance payment shall serve as a basis for determining the unemployment benefit. The employee's support level is the total unearned unemployment insurance payment period as of September 30, 2021 . The amount of support: 1 time support in cash with specific levels as follows: - The period of payment of unemployment insurance under 12 months: support 1,800,000 VND/person. - Time of paying unemployment insurance from full 12 months to under 60 months: support 2,100,000 VND/person. - Period of payment of unemployment insurance from full 60 months to less than 84 months: support 2,400,000 VND/person. - The period of payment of unemployment insurance from full 84 months to less than 108 months: support 2,650,000 VND/person. - Time of paying unemployment insurance from full 108 months to less than 132 months: support 2,900,000 VND/person. - Time of paying unemployment insurance from full 132 months or more: support 3,300,000 VND/person. |
