Foreign workers working in Vietnam must meet the following conditions:

- At least 18 years old and have full civil act capacity;

- Having professional qualifications, techniques, workmanship and experience; having sufficient health as prescribed by the Minister of Health;

- Not being a person who is serving his/her sentence or has not been expunged his/her criminal record or is being examined for penal liability in accordance with foreign law or Vietnamese law;

- Having a work permit issued by a competent Vietnamese state agency, except for cases not covered by the work permit:

+ Is the owner or a member contributing capital of a limited liability company with capital contribution value as prescribed by the Government.

+ Be the Chairman of the Board of Management or a member of the Board of Management of a joint-stock company with capital contribution value as prescribed by the Government.

+ Is the head of the representative office, project or takes the main responsibility for the activities of an international organization or foreign non-governmental organization in Vietnam.

+ Enter Vietnam with a term of less than 03 months to make a service offer.

+ Enter Vietnam with a term of less than 03 months to handle complex technical and technological problems and situations that affect or risk affecting production and business that Vietnamese experts and foreign experts currently in Vietnam cannot handle.

+ Being a foreign lawyer who has been granted a license to practice law in Vietnam in accordance with the Law on Lawyers.

+ In case under the provisions of an international treaty to which the Socialist Republic of Vietnam is a signatory.

+ Foreigner married to Vietnamese and living in the territory of Vietnam.

+ Other cases as prescribed by the Government.
