At the end of the year and on the Tet holiday, employees may receive some of the following bonuses or allowances:

Tet bonuses in Vietnam

Tet bonuses may include New Year's and Lunar New Year's bonuses.

According to Article 104 of the Labor Code 2019, "bonus" means an amount of money, a piece of property, or an item that is provided by an employer for his or her employees on the basis of the business's performance or the employees’ performance.

According to the above regulations, the bonus is not a mandatory amount that the enterprise must pay to the employee.

However, most businesses will have a bonus policy for the Tet holiday. The bonus level depends on the conditions of each business as well as the employee's contribution during the year.

The New Year's bonus (if any) will usually be lower than the Lunar New Year bonus.

Lunar New Year bonuses can also be the 13th month's salary.

However, the law does not have specific provisions, so in many places employees may receive both the Lunar New Year bonus and their 13th month salary at the same time.

Allowance for Tet from the union in Vietnam

Every year, the union will have a plan to support employees who are in a difficult situation on the Tet holiday.

On the occasion of Tet 2023, the Vietnam General Confederation of Labor issued Plan 266/KH-TLD on organizing activities to take care of union members and employees on the occasion of the Lunar New Year 2023.

Regarding the level of care for Tet 2023, the Labor Confederation of provinces and cities; the Central Sector Trade Union and equivalent; the Corporation's Trade Union under the General Confederation of the General Confederation; and the immediate superior union at grassroots level:

On the basis of the number of employees, employees in difficult circumstances are allocated to be taken care of (equal to 10% of the total number of union members under management), and the funding source is made from the reserve fund and the operation fund. Regularly available to take care of employees and employees in difficult circumstances, the support level is 500,000 VND/person to be paid in cash.

For units with socialized revenue and a balance of revenue and recurrent expenditure during the year, they can actively spend more; the higher part of expenditure can be in cash or in kind.

Bonus for the annual leave that the employee has not yet taken

According to the Labor Code 2019, employees are only paid for annual leave if they do not take leave or have not taken full leave in the case of already quitting the job.

However, many businesses still pay employees an amount corresponding to the number of unpaid annual leave days.

Not only that, the number of uncompleted annual leave days is also added to the percentage by many businesses to evaluate Tet bonuses for employees.

Thus, in the event that at the end of this year, employees who leave work without taking full leave can request that the enterprise pay this amount,

Salary for working during the Tet holidays

New Year's Eve and Lunar New Year are the days off for employees to take leave from work and receive their full salary.

According to Point b, Clause 1, Article 112 of the Labor Code 2019, employees are entitled to five days off work and their full salary on the occasion of the Lunar New Year. If they go on duty or work overtime on New Year's Day, employees will be paid overtime.

Article 98 of the Labor Code 2019 clearly states that an employee who works overtime will be paid an amount based on the piece rate or actual salary as follows:

On normal days, at least 150%; on weekly days off, at least 200%; and during public holidays and paid leave, at least 300%, not including the daily salary or paid leave for employees receiving daily salaries.
