Recently, the Ministry of Labor, War Invalids and Social Affairs issued Circular 06/2020/TT-BLDTBXH on promulgation of list of occupations bound by strict requirements for occupational safety and health in Vietnam.

Issued with Circular 06/2020/TT-BLDTBXH is a list of 32 occupations bound by strict requirements for occupational safety and health in Vietnam. Compared with the list issued in Circular 13/2016/TT-BLDTBXH, Circular 06 has removed some occupations and added the following occupations bound by strict requirements for occupational safety and health:
- Operation, maintenance, repair, dismantlement, inspection and supervision of operation of machinery and equipment including machine hammers, sludge dredging vessels or machines, pumps; mortar pumps, mortar mixers, mortar grouting machines and concrete sprayers
- Directly assembling, operating, repairing, maintaining and cleaning hydraulic jacks; polishing machines, sanding machines, conveyor belts, water guns, pneumatic guns; industrial printing machines.
- Working on water surface or on rigs, scuba diving or supervising diving; assembling machinery and equipment in ship’s holds and on waterway vessels.
- Working in contact with radiation, nuclear; operate scanners, projectors, and cameras using nuclear radiation, electromagnetic fields.
- Working in contact with high-frequency electromagnetic fields in the frequency range of 3KHz or higher.
- Forest planning and inventory
- Construction jobs including construction supervision; construction survey; trial operation of works.
- Directly operating trains and trams; driving, repair and maintenance of all kinds of automobiles.
- Directly operate trains, electric trains; drive, repair, and maintain all types of cars.
- Directly manufacturing and processing building materials, chinaware, porcelain, glass and plastic.
- Professional rescue.
- Direct manufacturing and processing of leather and feathers; dyeing; silk processing.
- Directly cutting, sawing, extracting and processing industrial wood; regular manual handling of objects weighing 30 kg or more.
- Directly cooking or processing food at collective kitchens providing serving capacity of 300 rations each day.
- Medical examination and treatment; taking care of disabled and sick people; pathology, forensic examination and micro-biological testing; occupations in pharmaceutical industry.
- Testing and manufacturing of veterinary drugs; preservation of genes, micro-organisms and parasites; environmental sterilization and disinfection; food inspection and sterilization.
- Directly slaughtering animals, caring and breeding large animals in production and business establishments; farming and training sniffer dogs, wild animals, snakes and crocodiles and destroying infected animals.
- Direct operation of petrol, oil and liquefied petroleum gas pumps; repair of petrol and oil tanks, and delivery, receipt, wholesale and retail of petrol and oil.
- Direct processing of rubber latex and resin.
- Directly operating production and processing of beer, spirits, soft drinks, tobacco, cooking oil, confectionery and milk.
- Circus, animal circus performers; professional athletes, professional fitness and sports coaches.
- Working with computer display devices including air traffic control, operation or remote control via displays.
- Directly doing cremation and burial work.
- Special occupations in the military sector on the List of arduous, hazardous and dangerous occupations, and extremely arduous, hazardous and dangerous occupations.
- Directly operating motorized agricultural machinery including threshers, harvesters, harrowers, grass cutting mowers, plant protection sprayers and water pumps.
In addition, Clause 5, Article 1 of Decree 140/2018/ND-CP stipulates: Group 3: Employees performing the tasks subject to strict requirements for occupational safety and health, which are on the list of tasks subject to strict requirements for occupational safety and health promulgated by the Ministry of Labor, War Invalids and Social Affairs.
In addition, Clause 3, Article 18 and Clause 3, Article 19 of Decree 44/2016/ND-CP stipulate the content and duration of occupational safety and health training for Group 3 as follows:
Training content:
- System of policies and law on occupational safety and sanitation;
- Basic knowledge about occupational safety and sanitation: Policies and regulations on occupational safety and sanitation for the employees; basic knowledge about dangerous and harmful factors at workplace and method for improvement of working conditions; functions and duties of the safety network, sanitation employees; safety culture in production and business; rules of occupational safety and sanitation, signs and signposts of occupational safety and sanitation and use of safety equipment, means of personal protection; techniques and skills of first aid of occupational accidents and prevention of occupational diseases;
- Content of specialized training: General knowledge about machine, equipment, materials and substances generating dangerous and harmful factors and the method for analysis, evaluation and management of risks related to the work with strict requirements on occupational safety and sanitation which the trainees are performing; procedures for safe work, occupational sanitation; safety techniques and occupational sanitation related to the work of employees;
Training time: at least 24 hours, including testing time.
Therefore, from October 5, 2020, workers participating in the above new occupations are required to attend occupational safety and health training course according to Decree 44/2016/ND-CP.
