On November 20, 2019, the National Assembly officially passed the 2019 Labor Code. The Labor Code 2019 was passed consisting of XXVII Chapters, 220 Articles with many notable new points, specifically:

Increase in retirement age to 60 for women, 62 for men

This is stipulated in Article 169 of the Labor Code 2019. To be specific, from 2021, the retirement age will increase by 03 months per year for male workers and 04 months per year for female workers until reaching 62 for men in 2028 and 60 for women in 2035.

Additional public holidays for workers, officials, and public employees

This content is specified in Clause 1 Article 112 of the Labor Code 2019, whereby workers will have 02 days off during the National Day holiday, increasing the total number of public holidays to 11 days.

Workers can unilaterally terminate labor contracts without prior notice

The Labor Code 2019 introduces 07 cases where workers are entitled to leave without prior notice:

- Not being arranged by the employer according to the correct job, working location, or not ensured working conditions as agreed;- Not being paid in full or on time;- Being mistreated, beaten by the employer, or subject to insulting words, behaviors that affect health, dignity, and honor; forced labor;- Being sexually harassed at the workplace;- Female workers who are pregnant may leave according to the provisions of Clause 1 Article 138 of this Code;- Reaching retirement age, except where otherwise agreed upon by both parties;- The employer provides untruthful information in accordance with Clause 1 Article 16 of this Code, affecting the implementation of the labor contract.

Seasonal labor contracts will no longer apply

The Labor Code 2019 removes seasonal labor contracts from the types of labor contracts that employers and employees are allowed to sign. From January 01, 2021, only 02 types of labor contracts remain: fixed-term labor contracts and indefinite-term labor contracts.
