03 job groups in Vietnam are recruited and used underage workers

Not all jobs and occupations in Vietnam are currently allowed to employ juvenile workers. The following are three groups of jobs by age group that employers are allowed to use underage workers:

1. Jobs employed persons aged under 13 in Vietnam

According to Clause 3, Article 145 of the Labor Code 2019, employers may only recruit and employ persons under 13 years of age to do the following jobs in Vietnam: artistic, physical training and sports work without harming the physical, intellectual and personality development of persons under 13 years of age.

Note: The recruitment and use of workers under the age of 13 in Vietnam must have the consent of the specialized agency in charge of labor under the provincial People's Committee.

2. Jobs recruited and employed persons aged between full 13 and under 15 in Vietnam

Employers may only recruit and employ persons aged from 13 to under 15 in Vietnam to perform light work as prescribed in Clause 3, Article 143 of the Labor Code 2019 (guided by Article 8 of Circular 09/2020/TT-BLĐTBXH), including:

- Art performance

- Sportsman.

- Software programming.

- Traditional professions in Vietnam: ceramic glaze polishing; pearl peel sawing; paper making; leaf cone making; cone polishing; weaving; blanking; terracotta weaving; terracotta embroidery; rice hams making; moulding; bean rack making; baking; multifilament baking; silk weaving; lotus flower yarn weaving; painting lacquer, freckles, gold weaving (except for the stages of using toxic chemicals such as paints, detergent chemicals, chemicals used for coloring, odorants, curved freckles...).

- Handicrafts in Vietnam: lace embroidery; handicrafts; horn combs; folk painting (Dong Ho painting, Hang Drum painting...); curiosities; wood carving, silk painting; picking up seashells, sponges to mount on handicrafts; grinding and polishing handicrafts; stringing beads, polishing handicraft jewelry; puppetry dolls; greeting cards products from decorative art paper on greeting cards; making picture frames of paper models, paper boxes, paper bags.

- Knitting, making household items, handicrafts from natural materials such as rattan, bamboo, pineapple, coconut, bananas, green urchins, jute, papaya, cinnamon, cloves, cones.

- Packages of fermented pork roll, confectionery packages, bakery packages (except for the operation or use of packaging machines, equipment and tools).

- Feeding the silk.

- Making grasses and vegetable gardens clean; harvesting vegetables, tubers and fruits clean according to the season.

- Livestock grazing on the farm.

- Accessories for removing fish nets, knitting fish nets, drying aquatic products.

- Cutting thread, knotting, embroidery, packing into boxes of hand-woven products.

3. Jobs recruited and employed persons aged between full 13 and under 15 in Vietnam

According to the provisions of the Labor Code, employers may recruit and employ persons aged from 15 to under 18 in Vietnam to participate in labor, except for jobs or jobs banned from employing workers aged from 15 to under 18 specified in Article 147 of the Labor Code 2019.

* Occupation and work of persons aged 15 to under 18 in Vietnam may be overtime in Vietnam

- Art performance

- Sportsman.

- Writing contents, writing newspapers.

- Software programming.

- Traditional professions: ceramic glaze dot; paper making; leaf cone making; fret making; cone dotting; projection weaving; blanking; terracotta weaving; terracotta embroidery; rice hams making; mould making; bean rack making; multipurpose baking; silk weaving; lotus flower yarn making.

- Crafts: lace embroidery; handicrafts; horn combs; folk painting (Dong Ho painting, Hang Drum painting...); curiosities; wood carving, silk painting; picking up seashells, scallops... to mount on art paintings; stringing rectangles; making doll puppets; greeting cards for products from decorative art paper on greeting cards; making frames of paper models, paper boxes, paper bags.

- Knitting, making household items, handicrafts from natural materials such as rattan, bamboo, pineapple, coconut, bananas, green urchins, jute, papaya, cinnamon, cloves, cones.

- Packages of fermented pork roll, confectionery packages, bakery packages (except for operating or using packaging machines, equipment and tools).

- Cutting thread, knotting, embroidery, packing into boxes of hand-woven products.

- Newsletters, letters, parcels; packing of parcels.

- Home sales; telephone sales; online sales.

- Shoe polishing; processing and selling food on the sidewalk.

- Tutors; sweeping, helping in families; housekeeping.

- Security guard, car care for agencies, businesses, restaurants.

- Collect money from vending machines, record numbers from watches; cashier, supermarket sales.

- Work in restaurants, eateries, cafes: reception, beverage dispensers, extra tables, kitchen accessories, chefs, magazines.

- Office work in Vietnam: photocopying, typing, direct telephone.

- Sales services: clothing, shoes, books, groceries.

- Pre-processing agricultural products: sorting, peeling, peeling, separating kernels, packaging.

- Making grasses and vegetable gardens clean; harvesting vegetables, tubers and fruits clean according to the season.

- Keep livestock, poultry, worms, crickets, non-toxic and dangerous insects.

* Occupation and job of a person aged 15 to under 18 may be employed at night in Vietnam

- Art performance

- Sportsman.
