Who has the authority to mobilize the Mobile Police in Vietnam?

The National Assembly of Vietnam has approved Law on Mobile Police 2022 stipulating the subjects allowed to mobilize the Mobile Police, specifically as follows:

According to Article 20 of the Law on Mobile Police 2022, the following 04 subjects are allowed to mobilize the Mobile Police, including:

(1) The Minister of Public Security of Vietnam: mobilize mobile police across the country to carry out their duties.

(2) Mobile Police Commander of Vietnam: mobilize the Mobile Police to perform the tasks listed below:

- Mobile police units under their authority to perform tasks according to plans and plans under their approving competence;

- The mobile police unit, according to the plan approved by the superior, authorized to approve or when assigned to assume the prime responsibility for handling specific situations;

- The mobile police unit under its authority to perform tasks in urgent cases and at the same time report to the Minister of Public Security.

(3) Directors of provincial-level Public Security in Vietnam: to assign mobile police units under their authority to perform tasks in the following cases:

- Perform tasks according to plans and plans approved by superiors or under their approval competence;

- Perform tasks in the area under their management in urgent cases and at the same time report to the Minister of Public Security.

(4) Command of mobile police units: mobilize and use units under their command to perform tasks in accordance with plans and plans approved by competent authorities; mobilize subordinate units to participate in disaster prevention, combat, and relief; natural disasters, epidemics, search and rescue; and report to the immediate superior commander.

The mobilization of the Mobile Police in a state of war, emergency, martial law, or curfew shall follow the regulations of the law and decisions of competent authorities.

(In contrast to current regulations in Vietnam, subjects who are Regiment-level Commanders, Mobile Police Battalions stationed independently no longer have the authority to mobilize Mobile Police.)

Law on Mobile Police 2022 takes effect from January 1, 2022.
