When converting from ID card to citizen identity card in Vietnam, is it required to correct the information in the Red book? This is a question that LawNet receives quite a lot from customers and members in recent days. Regarding this issue, LawNet would like to answer as follows:
Red book is the common way people call the certificate of land use rights, ownership of houses and other assets attached to land. According to the Ministry of Public Security of Vietnam, it is expected that from January 1, 2021 to July 1, 2021, 50 million chip-based citizen identification cards will be issued to people. Currently, there are 02 types of ID cards being circulated throughout the country: 9-digit ID card and 12-digit ID card. Because an ID card has a 12-digit identifier, in the case of converting from a 9-digit ID card to a chip-based citizen identification card, the identifier will change compared to the old ID number. As for the case of switching from a 12-digit ID card to a chip-based ID card, the identification number remains the same, unchanged.
This transformation aims to enhance the security and ability of citizens to keep personal information, and at the same time to make it more convenient for authorities to manage the population. This conversion does not affect the value of legal documents with ID numbers. Specifically, according to Clause 3 Article 38 of the Law on Citizen Identification 2014 of Vietnam, legally valid papers already issued that use information on people’s identity cards remain valid. The ID number and citizen identification number are recorded on page 1 of the Red book. Therefore, the Red book is still valid when converting from ID card to citizen identification card.
When converting from ID card to citizen identity card, is it required to correct the information in the Red book?
Regarding this issue, pursuant to Point g Clause 1 Article 17 of the Circular No. 23/2014/TT-BTNMT (amended by Clause 14 Clause 6 of the Circular 33/2017/TT-BTNMT):
Land users or owners of properties associated with land are allowed to change name and personal and legal information and address;
Land users and owners of land-attached assets are allowed to change their names; certify the change of information about the legal entity, ID card number, citizen identity card number, and the address on the issued Certificate according to the needs of the land user and owner of property on land; certify the change of information about the legal entity, ID card number, citizen identity card number, and the address on the issued Certificate concurrently with the procedures for registration of changes in land and land-attached assets.
According to the above regulations, the change of ID card number or citizen identity card number is made according to the needs of the land user. In other words, when people are issued a chip-based citizen identity card, if the issued card number is different from the number in the Red book, people have the right to request a change.
In case people need to confirm the change of their ID card number, people need to follow the steps below:
Step 1: Repair dossiers include of:
- Application for registration of changes according to Form No. 09/DK;
- The original issued Red book;
- Copy of new ID card;
- Original Certification of the competent police agency on the change of ID card;
- Certified copy of the household registration book (if the information on the ID number in the household registration book has not been changed, it must be done before confirming the change of the ID number in the Red book).
Step 2: Submit the application at the Land Registration Office, the Branch of the Land Registration Office where the land is located.
For places where the land registration office has not yet been established, the land use right registration office shall continue to certify in the granted certificate.
Step 3: Within no more than 10 days from the date of receipt of a valid application, the Land Registration Office must certify the change of the ID number on page 3 or page 4 of the issued Certificate.
In short, when converting from ID card to citizen identity card, it is not required to correct the information in the Red book, while the information in the Red book shall be changed according to the needs of the owner.
