1. What is courtroom?

According to Clause 1, Article 2 of Circular 01/2017/TT-TANDTC, courtroom is the space to organize the trial of criminal and administrative cases; adjudicate and settle civil and bankruptcy cases, and consider and decide to apply administrative handling measures of the Court.

In which, the court room includes cassation and reopening court rooms; courtrooms of first instance, and appellate courts.

2. Regulations on the form of courtrooms according to Vietnamese law

Specifically, in Article 4 of Circular 01/2017/TT-TANDTC, the form of the courtroom is prescribed as follows:

- The courtroom must be arranged with the National Emblem of the Socialist Republic of Vietnam on a wooden paneled foundation in the middle, behind and above the position of the Trial Council, the Council for Settlement of Civil and Bankruptcy Matters. The judge presides over the court session and the meeting.

- The courtroom is arranged with two podiums, except for the courtroom, which handles cases under the jurisdiction of the Family and Juvenile Courts.

The position of the Trial Panel, the Council for Settlement of civil and bankruptcy matters, the judge presiding over the court session and the meeting shall be on the highest podium; The second podium is the position of other procedure-conducting persons, procedure participants, and attendees of court sessions and sessions.

- The courtroom must ensure space for conducting court hearings and sessions and a barrier separating the area of the procedure-conducting persons and procedure participants from the area of the court hearing or meeting participants;

- The courtroom must arrange separate passages for the Trial Panel, the Council for settlement of civil and bankruptcy matters, and the judge presiding over the court session and presiding over the meeting; aisles of other procedure-conducting persons, procedure participants, and participants in court sessions and sessions; The wall in the courtroom has a yellow background.

- The location map of procedure-conducting persons, procedure participants, court hearings, and courtroom sessions shall be made according to Appendix 01 issued together with Circular 01/2017/TT-TANDTC.

- In case of a mobile trial, the courtroom must arrange the National Emblem of the Socialist Republic of Vietnam on a blue background in the middle, behind, and above the position of the Trial Panel.

The desks for the proceedings are covered with towels of the same color as the background.

3. Regulations on equipment in courtrooms in Vietnam

Equipment in the courtroom must comply with the provisions of Article 5 of Circular 01/2017/TT-TANDTC, specifically as follows:

- The courtroom must have the National Emblem of the Socialist Republic of Vietnam; podium position of the Trial Panel, the Council for Settlement of civil and bankruptcy matters, the judge presiding over the court session, the judge presiding over the meeting; tables, chairs, declaration podiums, separation fences, courtroom rules boards, signboards with titles of procedure-conducting persons, signboards with status of procedure participants, a lighting system, electric fans, and a sound system.

Depending on the specific conditions of each Court, the courtroom may be equipped with additional audio and video recording equipment, television screens, computers, the internet, online television networks, and other equipment. other for trial work.

- Tables, chairs, a wood-paneled background to arrange the National Emblem of the Socialist Republic of Vietnam, a declaration podium, and a separation fence in the courtroom must meet the following standards:

+ Color: brown;

+ Material: natural wood or industrial wood.

- A board of courtroom rules with a blue background and white letters is hung outside the main door of the courtroom; the signboard with the name of the person conducting the proceedings has a red background, yellow letters; the signboard stating the eligibility to participate in the proceedings of others has a blue background, white letters.

- Dimensions of the National Emblem of the Socialist Republic of Vietnam; wooden paneled background to arrange the National Emblem of the Socialist Republic of Vietnam; podium position of the Trial Panel, the Council for settlement of civil and bankruptcy matters, the judge presiding over the court session, presiding over the meeting; Tables, chairs, declaration podiums, separation fences, courtroom rules boards, signboards with titles of procedure-conducting persons, and signs stating the status of procedure participants shall comply with Appendix 02 promulgated together with Circular 01/2017/TT-TANDTC.
