1. What is guard?

According to Clause 1, Article 3 of the Law on Guards 2017,  guard is a special protection work organized by the State to ensure absolute safety for the guarded subjects.

Guard operation is the implementation of security measures to ensure absolute safety for the objects of the guard.

The subjects of the guard are those holding high-ranking positions and titles within the Communist Party of Vietnam, the State of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front; international visitors to visit and work in Vietnam; material areas; In particular, important events are security measures and regimes in accordance with the provisions of the Law on Guard 2017.

2. Principles of guard operation in Vietnam

Guard operation principles are prescribed in Article 5 of the Law on Guards 2017 as follows:

- Comply with the Constitution and laws; ensure the interests of the State and the lawful rights and interests of organizations and individuals.

- Work under the absolute and direct leadership of the Communist Party of Vietnam in all aspects; the unified management of the State; the direct direction of the Minister of Public Security and the Minister of National Defense.

- Proactively prevent, detect, and promptly stop all plots, activities, acts, and other factors infringing upon the safety of the guard subjects.

- Rely on the people, promoting the synergy of the political system and the whole society; combine public and covert activities to carry out security work.

- Ensure centralized and unified command and control and direction from the central to local levels.

3. Entities and occasions required to have guards under the Law on Guard in Vietnam

Entities required to have guards are specified in Article 10 of the Law on Guards 2017 as follows:

- Holders of high-ranking positions and titles within the Communist Party of Vietnam, the State of the Socialist Republic of Vietnam, and the Central Committee of the Vietnam Fatherland Front include:

+ General Secretary of the Central Committee of the Communist Party of Vietnam;

+ President of the State;

+ President of the National Assembly;

+ Prime Minister;

+ Former General Secretary of the Central Committee of the Communist Party of Vietnam, former President, former President of the National Assembly, former Prime Minister;

+ Member of the Politburo of the Central Committee of the Communist Party of Vietnam;

+ Secretary of the Central Committee of the Communist Party of Vietnam;

+ Chairman of the Central Committee of the Vietnam Fatherland Front, Vice President of the State, Vice Chairman of the National Assembly, Deputy Prime Minister.

- International visitors to visit and work in Vietnam include

+ Head of State, legislative body, Government;

+ Deputy heads of the heads of state, legislative bodies, government, on the basis of reciprocity;

+ Guests of the General Secretary of the Central Committee of the Communist Party of Vietnam, the President, the President of the National Assembly, and the Prime Minister;

+ Other guests at the Minister of Foreign Affairs' request, on the basis of reciprocity.

- Key areas include:

+ Working area of the Party Central Committee;

+ Working area of the President;

+ Working area of the National Assembly;

+ Government working area;

+ Ho Chi Minh Mausoleum; Ho Chi Minh Museum; Relics of the Presidential Palace; Ba Dinh Square; Monument to Heroes and Martyrs at Bac Son Street, Ba Dinh District, Hanoi City;

+ The Minister of Public Security shall stipulate the scope of guarding the above key areas.

- Important special events include:

+ National Congress of the Party;

+ Conference of the Central Committee of the Party;

+ Sessions of the National Assembly;

+ Meetings of the Politburo, the Secretariat, the National Defense and Security Council, the National Assembly Standing Committee, the Government;

+ Conferences and festivals organized by the Party and State Central Committees; national congresses organized at the central level by sociopolitical organizations; international conferences held in Vietnam where the subjects of bodyguard specified in Clause 1, Point a and Point b, Clause 2, Article 10 of the Law on Guards 2017 attend or chair the conference.
