1. What are military weapons?

Military weapons include:

- Weapons that are manufactured or crafted satisfactory to technical standards and design of legal manufacturers and provided for people’s armed forces and other forces as specified herein to perform certain tasks, including:

+ Firearms: handguns, rifles, submachine guns, light machine guns, anti-tank guns, grenade launchers;

+ Light weapons: heavy machine guns, mortars, DKZ rifles, anti-aircraft machine guns, man-portable anti-tank rocket launchers;

+ Heavy weapons: fighter aircrafts, attack helicopters, tanks, armored vehicles, warships, submarines, artillery, anti-aircraft artillery, rockets;

+ Bombs, mines, grenades, torpedoes, naval mines; ammunition for weapons specified in this Point;

- Weapons that are manufactured or crafted manually or industrially without satisfying technical standards and design of legal manufacturers capable of inflicting damage and harm to lives and health of humans, destroying matter structures similar to weapons specified in Point a of this Clause and not provided for people’s armed forces and other forces specified in Article 18 of this Law to perform tasks.

2. Entities equipped with military weapons in Vietnam

Entities equipped with military weapons are specified in Article 18 of the Law on management and use of weapons, explosives and combat gears 2017 as follows:

- The following entities are equipped with military weapons:

+ Vietnam People’s Army;

+ Vietnam Civil Defense Force;

+ Vietnam Coast Guards

+ Vietnam People's Public Security

+ Cipher force;

+ The investigating authority affiliated to People’s Supreme Procuracy;

+ Foresters and Vietnam Fisheries Resources Surveillance;

+ Aviation security force;

+ Customs officers working at border checkpoints and specialized forces carrying out tasks of anti-smuggling affiliated to Vietnam Customs.

- According to features, requirements and missions, the Minister of National Defense shall stipulate the equipment of military weapons for personnel of Vietnam People’s Army, Vietnam Civil Defense Force, Vietnam Coast Guard and cipher force under the management of the Ministry of National Defense.

- According to the features, requirements and missions, the Minister of Public’s Security shall stipulate the equipment of military weapons for entities not under the management of the Ministry of National Defense.

3. Procedures for being equipped with military weapons in Vietnam

* Procedures for being equipped with military weapons applying to persons not under the management of the Ministry of National Defense shall be specified as follows:

- An application shall consist of

+ An application form made by the applicant and specifying reasons, demands, conditions, types and quality of weapons, written approval issued by heads of ministries;

+ A copy of decision on establishment of the applicant;

+ A letter of introduction enclosed with a copy of ID card, passport or police ID card of the addressing person;

- An application containing the documents prescribed in Point a of this clause shall be submitted to the competent authority assigned by the Minister of Public Security.

- Within 5 working days from the day on which the adequate application is received, the police authority shall issue the license to be equipped with military weapons and instruct the applicant to equip these weapons or send a written explanation to the applicant in case of refusal to issue the license.

- The period of license to be equipped with military weapons shall be 30 days.

* Procedures for providing military weapons for personnel of Vietnam People’s Army, Vietnam Civil Defense Force, Vietnam Coast Guards and cipher force under the management of the Ministry of National Defense shall comply with regulations issued by the Minister of National Defense.
