What are penalties for failing to notify before stopping the electricity supply in Vietnam?

Notifying when stopping electricity supply is the responsibility of the seller to avoid and reduce damage to the buyer. So what are penalties for failing to notify before stopping the electricity supply in Vietnam?

1. Cases in which the electricity seller may stop or reduce electricity supply level

Pursuant to Article 14 of Decree 137/2013/ND-CP stipulating that in the following circumstances, the electricity seller may stop or reduce electricity supply level:

- Stop and reduction of electricity supply level as prescribed at Article 27 of the Electricity Law:

+ In case of non-urgent cessation or reduction of electricity supply,

Except for cases prescribed in Clause 6, Article 23 of Electricity Law, the electricity sellers must notify the electricity buyers thereof at least five days before the time of electricity supply cessation or reduction by announcing such for three consecutive days on the mass media or in other forms of information.

+ In case of urgent cessation or reduction of the electricity supply due to incidents or force majeure events, which are beyond the electricity sellers' control and threaten to cause serious unsafely for human beings, equipment or due to electricity shortage which threatens the safety of the electric systems:

The electricity-generating, -transmitting or -distributing units may cease or reduce the electricity supply to the electricity buyers for handling and must within 24 hours notify the electricity buyers of the causes and the estimated time for resumption of electricity supply.

+ In cases where electricity units cease or reduce the electricity supply in contravention of the regulations on electricity supply cessation or reduction, they shall be sanctioned according to law provisions on handling of administrative violations

If causing damage, they must pay compensations to the electricity buyers according to law provisions,

+ In cases where the electricity buyers fail to comply with the provisions at Points a and b of Clause 2, Article 46, Points b and c of Clause 2, Article 47 of Electricity Law, the electricity sellers may cease the electricity supply to the electricity buyers.

- The Electricity purchaser commits violations of provisions at Clauses 1, 4, 5, 6, 7 and 8 Article 7 of the Electricity Law:

+ Destroying electrical equipment and facilities, electricity-measuring or counting equipment or electricity works.

+ Violating the regulations on safety in electricity generation, transmission, distribution and use.

+ Obstructing the inspection of electricity activities and use.

+ Stealing electricity.

+ Using electricity as animal traps or protection means, except for cases prescribed in Article 59 of Electricity Law.

+ Violating the regulations on protection of electricity grid safety corridors, on safe distances of transmission tines and transformer stations.

- At the request of competent state agencies in case where organizations or individuals violate provisions of the Electricity Law, Construction Law, law on environment protection.

2. What is the penalty for stopping power without prior notice to the seller in Vietnam?

At point b, clause 7, Article 11 of Decree 134/2013/ND-CP, as amended by Decree 17/2022/ND-CP, stipulating  A fine ranging from VND 50.000.000 to VND 60.000.000 shall be imposed on Electricity retailers for acts of failing to notify or fail to implement the notice in accordance with Regulations on procedures for suspending, reducing electricity supply issued by Ministry of Industry and Trade of Vietnam

Thus, the act of stopping power without notice will be fined 50 million to 60 million dong.
