From June 19, 2020, the National Assembly of Vietnam officially approved the Law on Organization of the National Assembly amended in 2020, which takes effect from January 01, 2021.
According to Clause 2 Article 1 of the Law on Organization of the National Assembly amended in 2020 of Vietnam: “Full-time National Assembly deputies shall account for at least 40% of the total number of National Assembly deputies.” (according to current regulation of the Law on Organization of the National Assembly 2014, the number of full-time National Assembly deputies must account for at least thirty five percent of the total number of National Assembly deputies).
According to Article 23 of Law on Organization of the National Assembly 2014: “The total number of National Assembly deputies must not exceed 500, including fulltime and part-time National Assembly deputies.”.
Besides, the Law on Organization of the National Assembly amended in 2020 also supplements responsibilities of part-time National Assembly deputies, specifically as follows:
- Full-time National Assembly deputies shall attend conferences of full-time National Assembly deputies and other conferences convened by the Standing Committee of the National Assembly.
- Part-time National Assembly deputies have the right to attend conferences of full-time National Assembly deputies to discuss matters of concern to them.
Moreover, from January 01, 2021, National Assembly deputies must meet the following criteria:
- To be loyal to the Fatherland, the People and the Constitution, to strive to carry out the renewal cause for the goal of a prosperous people and a strong, democratic, equitable and civilized country.
- To hold citizenship of only Vietnam (not regulated in the Law on Organization of the National Assembly 2014).
- To possess moral qualities, to be diligent, thrifty, incorruptible, public-spirited and selfless, exemplary in the observance of law; to have the spirit and be determined to control corruption, waste and all manifestations of bureaucracy, imperiousness and authoritarianism and other illegal acts.
- To possess educational and professional qualifications, to have full capacity, health, work experience and prestige to perform the tasks of a National Assembly deputy.
- To keep close ties with the People, to listen to opinions of the People, to gain confidence of the People.
- To have the conditions to participate in the activities of the National Assembly.
