Vietnam: Preferential regimes for the relatives of martyrs applies from July 01, 2021

The preferential regime for relatives of martyrs is clearly specified in the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam.

According to Article 16 of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam, preferential regimes for relatives of martyrs include:

(1) Issue "Certificate of family of martyrs".

(1) One-time survivorship allowance when posthumously conferring the diploma of "Fatherland attribution"; in case there are no relatives left, the heirs of martyrs holding the diploma of "Fatherland attribution" will be entitled to a one-time survivorship allowance.

(3) Monthly survivorship allowance for the following people:

- The martyr's biological father, biological mother, child is under 18 years old, or full 18 years old if he/she continues to go to school, or suffers from severe disability, particularly severe disability, or the person who has contributed to taking care of martyrs; in case there are many martyrs, the relatives of two martyrs and relatives of three or more martyrs shall be considered;

- Martyrs' spouses.

(4) In case the biological father, biological mother, the person who has contributed to taking care of martyrs, martyrs' spouses specified in Clause 3 Article 16 of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 living alone, and martyrs' children specified in Clause 3 of this Article are orphans whose both parents are dead are entitled to additional monthly severance allowance.

(5) Health recovery nursing every two years for biological fathers, biological mothers, the person who has contributed to taking care of martyrs, martyrs' spouses and children with severe disabilities or particularly severe disabilities. In case the biological father or mother has only one child who is a martyr or has two or more children of martyrs, they are entitled to annual health rehabilitation by nursing.

(6) Health insurance for biological fathers, biological mothers, the person who has contributed to taking care of martyrs, martyrs' spouses and children.

(7) Priority in enrollment and job creation.

(8) Support to study up to the university level at educational institutions of the national education system.

(9) Support for housing improvement based on each person's merits and circumstances or when there are housing difficulties.

(10) Exemption or reduction of land use levy when being allocated residential land by the State, changing the land use purpose to residential land, recognizing the right to use residential land, when purchasing houses owned by the State.

(11) Prioritize allocation or lease of land, water surface, sea surface; prioritize forest protection and development contracts.

(12) Preferential loans for production and business.

(13) Tax exemption or reduction as prescribed by law.

(14) Provide necessary assistive devices, orthopedic tools, means and equipment for rehabilitation as specified by orthopedic and rehabilitation establishments in the labor - war invalids and social sector or of provincial hospitals or higher for relatives of martyrs who are enjoying monthly survivorship allowance.

(15) Support to visit martyrs' graves, move martyrs' remains.

(16) Martyrs' spouses marry other husband/wife but still take care of martyrs' children until they reach adulthood or take care of martyrs' biological fathers and mothers while they are still alive or due to revolutionary activities that have no conditions to take care of their biological fathers when a martyr's biological father or mother is still alive, he/she shall enjoy the following preferential regimes:

- Monthly survivorship allowance;

- Health insurance.

(17) One-time allowance for relatives at the rate of 3 months of current monthly allowance when the subjects specified in Clause 3 of this Article who deserve the monthly allowance die, unless the subjects specified in Clause 10 of this Article die.

(18) Funeral allowance for the person or organization performing the funeral when the subjects specified in Clause 3 of this Article who are enjoying the monthly allowance die, except for the case where the subjects specified in Clause 10 of this Article die.

The Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam takes effect from July 01, 2020 and replaces the Ordinance on preferential treatment given to people with meritorious services to the revolution 2005.
