On November 27, 2020, the Government of Vietnam issued the Decree No. 137/2020/NĐ-CP on management and use of pyrotechnics, officially effective from January 11, 2021. According to this Decree, regulations allowing people to set off consumer fireworks on holidays and New Year, specifically the upcoming Lunar New Year 2021, have also been officially approved.
Specifically, according to Article 17 of the Decree No. 137/2020/NĐ-CP of Vietnam’s Government:
Agencies, organizations and individuals having full legal capacity may use consumer fireworks during: National holidays, Tet holiday, marriage, conventions, grand openings, anniversaries, cultural and art activities.
Agencies, organizations and individuals shall only purchase consumer fireworks at organizations and enterprises eligible for manufacturing and trading consumer fireworks.
According to this provision, conditions for setting off consumer fireworks on the upcoming Lunar New Year 2021 are:
(1) Agencies, organizations and individuals must have full legal capacity; and
(2) Consumer fireworks must be purchased at organizations and enterprises eligible for manufacturing and trading consumer fireworks.
Decree No. 137/2020/NĐ-CP of Vietnam’s Government divided pyrotechnics into firecrackers and consumer fireworks. In which, firecrackers consist of fireworks and short-range fireworks. Features to distinguish firecrackers and consumer fireworks are that firecrackers emit explosive sound and color effect while consumer fireworks only emit sound, light or colorful effects without emitting explosion sound effect.
It is permitted to set off consumer fireworks on national holidays and Tet holiday, so that people need to pay attention to choose only the type of consumer fireworks which are products manufactured manually or industrially which, upon mechanical, chemical, thermal or electrical impact, will emit sound, light or colorful effects without emitting explosion sound effect.
Besides having to choose the right type of consumer fireworks that are allowed to set off during the holidays, Tet especially during the upcoming Lunar New Year 2021, people must pay special attention to only purchasing consumer fireworks at organizations and enterprises eligible for manufacturing and trading consumer fireworks.
Thus, people are allowed to set off consumer fireworks during the upcoming Lunar New Year 2021 to celebrate. Not only that, on other holidays and anniversaries of the year such as Valentine's Day (February 14), wedding anniversaries, birthdays, etc., people can still set off fireworks to celebrate.
