Vietnam: Instructions for collecting voters' opinions on geographical borders of administrative divisions

The Ministry of Home Affairs of Vietnam is collecting comments on the Draft Circular guiding the collection of voters' opinions on the establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions specified in Clause 2 Article 131 of the Law on Local Government Organization 2015 of Vietnam.

Clause 2 Article 131 of the Law on Local Government Organization 2015 of Vietnam:

2. The Government shall be responsible for conducting this referendum on the establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions and performing the following tasks:

a) Decide the time when this referendum takes place, opinion ballot templates and supporting materials;

b) Direct, provide guidance on and inspect the People's Committee at all levels in relation to the referendum; direct the task of spreading and dissemination of information about the referendum;

c) Provide adequate budget and necessary conditions to facilitate this referendum;

d) Make the referendum result known to the public through the Government's website.

Time to consult

After having completed the Scheme on establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions (referred to as Scheme), within a maximum period of 60 days, the People's Committee of the province shall organize the collection of voters' opinions in the commune-level administrative units, which are directly affected by the establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions in the locality.

Documentation for consultation

 

    1. Documents to be distributed together with the proposal form Summary of the Scheme, clearly stating:

       + Scheme on establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions;
      + Brief assessment of conditions and standards of the administrative division (if any);

       + List of documents, guidelines and orientations of the Party and State.

 

2. Documents posted on the web portal of the People's Committee and posted at the headquarters of the People's Committee are the entire content of the Scheme on establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions.

 

Note: The posting and listing of the Scheme shall be carried out within 30 days and within that time, the opinions of voters must be collected.

Publicize the results of the consultation

The publication of results of polling of voters on the Government's website must be carried out:

- Before the Ministry of Home Affairs appraises and submits to the Government the Scheme and;

- Before the Minister of Home Affairs submits to the Prime Minister for decision to establish a Council to appraise the Scheme on establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions.

Dossier for voters' opinions

Including:

- Voter opinion form (01 vote per commune-level administrative division);

- Documents to be distributed with the opinion form;

- Summary report on results of polling voters of villages, residential groups, commune-level People's Committees, and district-level People's Committees.

Dossiers of voter collection shall be sent to the Government by the People's Committee of the province, together with the report on the results of the collection of voters' opinions in the province or central-affiliated city for examination and appraisal.

Time to send the dossier for voters' opinions

- For the provincial level: The provincial People's Committee shall send the Government the dossier to collect opinions of voters before the Minister of Home Affairs submits it to the Prime Minister for decision on the establishment of a project appraisal council;

- For district and commune levels: Provincial People's Committees shall send to the Government the dossiers for collection of voters' opinions at the same time the provincial People's Committees submit the Scheme to the Government.

In some necessary cases, the Ministry of Home Affairs of Vietnam may organize an examination of the collection of voters' opinions on the establishment, dissolution, merging, splitting and modification of geographical borders of administrative divisions.
