Vietnam: Guiding the procedures for temporary postponement of military service

Military service is a citizen's obligation to his country, showing his patriotism. However, in some special cases, citizens will be temporarily postponed from military service. Below are instructions on how to apply for a temporary postponement of military service.

Step 1: Prepare dossier

Citizens subject to military service suspension shall prepare a dossier of application for military service postponement, including:

- Application for military service postponement;

- Documents proving that the citizen is eligible for temporary postponement of military service.

Example: In some specific cases below, citizens will prepare some corresponding documents, such as:

- Citizens who have not met heath requirements to serve in the army: Certificate of health status of the Health Examination Council;

- Citizen whose full brother/sister is a non-commissioned officer/active duty enlisted soldier or a non-commissioned officer/enlisted soldier performing service in People’s Army: Papers proving the citizen's personal relationship with these people;

- Citizen who is official or youth volunteer assigned to extremely disadvantage socio-economic area: Confirmation of the unit currently working;

- Students: Confirmation of the school currently learning;

- etc.

Step 2: Submit dossier

Citizens submit an application to postpone military service at the commune-level People's Committee where their permanent residence is registered for processing.

Step 3: Process dossier

- The commune-level People's Committee will examine the application for military service postponement, verify whether the citizen is eligible for military service postponement or not and send the dossier to the district People's Committee.

- The President of the People's Committee of the district shall issue a decision to postpone the call for military service.

Step 4: Receive result

The Commune-level People's Committee relies on the Decision of the Chairman of the District-level People's Committee to publicly post the list of citizens eligible for postponement of military enlistment at the headquarters of the commune-level People's Committee, agencies or organizations.

In case the conditions are not met, citizens still have to serve as normal.

Note: According to Clause 1 Article 41 of the Law on Military Service 2015 of Vietnam guided by Article 5 of Circular No. 148/2018/TT-BQP of the Ministry of National Defense of Vietnam, the following citizens shall have their conscription postponed:

1. Citizens whose health is unsatisfactory for active military service according to the conclusion of the pre-enlistment check-up board.

2. Citizen being the only breadwinner who directly takes care of his relatives who lost working capacity or under working age; citizen being the only breadwinner in a family suffering serious damage to humans and property due to dangerous accidents, disasters, epidemics confirmed by the People’s Committees of the communes, wards, towns.

3. Citizen who is a child of sick soldiers, people infected with dioxin and suffering labor capacity reduction from 61% to 80%.

4. Citizen whose biological siblings is a non-commissioned officer/active duty enlisted soldier or a non-commissioned officer/enlisted soldier performing service in the People's Army.

5. Citizens who are subject to emigration or evacuation in the first 03 years to extremely disadvantaged communes according to the socio-economic development project of the State decided by the People's Committees of provinces or higher levels.

6. Citizen who is an official or a youth volunteer assigned to an extremely disadvantaged socio-economic area according to the law provisions.

7. Citizen who is studying at a compulsory education institution or receiving training or university level at a higher education institution or training of college level at a vocational education institution for a training course of a level.

When there is no longer a reason for the postponement, the subjects are called for military service.
