Vietnam: Decree No. 136/2020/NĐ-CP abolishes some fire prevention and fighting safety conditions for residential areas

Decree No. 136/2020/NĐ-CP providing guidelines for a number of articles of law on fire prevention and fighting and law on amendments to law on fire prevention and fighting has annulled some fire prevention and fighting safety conditions for residential areas.

Pursuant to Article 6 of the Decree No. 136/2020/NĐ-CP of the Government of Vietnam, a residential area is a place where individuals and households live as parts of a village, hamlet, mountain village, neighborhood and equivalent residential unit (hereinafter collectively referred to as “village”). A village is a residential area subject to fire management.

Residential areas must satisfy the following fire safety requirements:

(1) Regulations on fire prevention and fighting and use of electricity, fire, flammable materials and explosives are provided in accordance with technical regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security of Vietnam;

(2) There are sufficient and quality traffic system, water supply for firefighting, fire spread preventing solutions and, fire prevention and fighting equipment in accordance with technical regulations and standards on fire prevention and fighting or regulations of the Ministry of Public Security of Vietnam;

(3) There is a firefighting plan approved by the competent authority.

(4) There is a neighborhood having received training in fire prevention and fighting operation and on-site combat-ready firefighters.

Note: Chairpersons of commune-level People’s Committees must organize and maintain compliance with the above-mentioned fire safety requirements throughout the existence of the residential areas.

In comparison with provisions of Article 8 of the Decree No. 79/2014/NĐ-CP, there are 07 fire safety regulations applied to residential areas as following:

1. There are regulations on fire safety, use of electricity, fire, inflammable substances; signs, diagrams or instructions on fire safety, firefighting, and escape plan that are suitable for the residential area.

2. If the residential area is a new one, its fire safety design must be approved. (annulled)

3. The electricity system is conformable with fire safety standards. (annulled)

4. There is a traffic system and water supply system serving firefighting, solutions for preventing spread of fire, adequate and decent fire safety and firefighting equipment according to fire safety and firefighting standards or regulations of the Ministry of Public Security.

5. There is a firefighting plan and escape plan approved by a competent authority.

6. There is a watchman team that is trained in fire safety and firefighting, and is ready to deal with conflagration on the spot.

7. There are documents serving management and monitoring of fire safety and firefighting activities as prescribed by the Ministry of Public Security. (annulled)

It can be seen that the Decree No. 136/2020/NĐ-CP of the Government of Vietnam has abolished some fire prevention and fighting safety conditions for residential areas such as fire safety design, electricity system is conformable with fire safety standards, etc. Therefore, from January 19, 2021, residential areas are just required to meet 04 fire safety requirements according to the Decree No. 136/2020/NĐ-CP.
