Vietnam: Changes of the conditions for recognition of martyrs from July 01, 2021

According to the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam, the conditions for recognition of martyrs from July 01, 2021 have changed a lot.

Specifically, according to Article 14 of the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam, those who have sacrificed for the revolutionary cause of national liberation, construction and defense of the Fatherland, performed international obligations or for the benefit of the State or the people shall be considered and recognized by competent authorities as martyrs in one of the following cases:

1. Taken part in fighting or directly served for fighting to protect independence, sovereignty, territorial integrity and national security; (previous provison: Taken part in fighting or directly served for fighting => adding “to protect independence, sovereignty, territorial integrity and national security”)

2. Performing national defense and security tasks in areas occupied by the enemy, areas with hostilities, and areas adjacent to areas occupied by the enemy; (new provision)

3. Directly carried out political struggle, agitation and propaganda among enemy troops; (remained)

4. Been captured and have suffered torture by the enemy during revolutions or resistance wars or taking part in revolutions or resistance wars but not surrendering and sacrificing himself/herself during prison-break; (previous provison: Been captured and have suffered torture by the enemy during revolutions or resistance wars but not surrendering and sacrificing himself/herself during prison-break => adding th case of taking part in revolutions or resistance wars)

5. Fulfilled international duties; (remained)

6. Bravely performed urgent and dangerous tasks serving national defense and security; (remained)

7. Directly performing combat training tasks, maneuvers or performing dangerous defense and security tasks; (new provision)

8. Suffered from diseases or accidents that cannot be treated in time while directly performing national defense and security tasks in border areas, at sea or on islands with severely poor socio-economic conditions according to the list prescribed by the Government; (previous provison: Suffered from diseases or accidents during performance of their duties of national defense and security in the area with severely poor socio-economic conditions => adding “in border areas, at sea or on islands” and “cannot be treated in time”)

9. Directly fought against offenders; (previous provison: Fought against offenders => adding “directly”)

10. Especially bravely saved people’s life and assets of the State and people or prevented and arrested people who committed crimes, being a meaningful example of honoring, educating, spreading widely in society; (previous provison: Saved people’s life and assets of the State and people => adding the condition of “especially bravely” and the case “prevented and arrested people who committed crimes, being a meaningful example of honoring, educating, spreading widely in society”);

11. Recurrent injuries are the main cause of death for war invalids, beneficiaries of policies like invalids specified in Clauses 1 and 2 Article 23 of this Ordinance who have a body injury rate of 61% or more and have a medical record for treatment of recurrent wounds from a hospital at the district level or higher and a record of death audit; (previous provison: War invalids or persons entitled to incentive policies like war invalids who died from illness relapse => adding the condition “have a body injury rate of 61% or more and have a medical record for treatment of recurrent wounds from a hospital at the district level or higher and a record of death audit”)

12. Missing in the cases 1, 2, 3, 4, 5, 6, 7, 9 and 10 mentioned above and concluded by a competent authority not to betray; surrender, retreat, desertion. (new provision)

Thus, the Ordinance on preferential treatment given to people with meritorious services to the revolution 2020 of Vietnam has expanded as well as detailed the conditions for being recognized as a martyr. This new regulation will officially take effect from July 01, 2021.
