Mobile police on duty will be equipped with a number of weapons and combat gears. Below are the types of weapons, explosives, combat gears, vehicles and technical equipment used by the mobile police on duty in Vietnam.
Types of weapons can be used by mobile police on duty in Vietnam
1. Mobile police weapons used in the course of duty
Mobile police use weapons, explosives, supporting tools, vehicles, and technical equipment according to Article 15 of the Law on Mobile Police 2022, specifically:
When performing independent tasks, Mobile Police officers and soldiers are allowed to use weapons, explosives, supporting tools, and open military firearms in accordance with the Law on Management and Use of Weapons, Explosives, and Combat Gears.
Clause 2, Article 3 of the Law on Management and Use of Weapons, Explosives, and Combat Gears 2017 amended by the Law on Management and use of Weapons, Explosives, and Combat Gears 2019 stipulates that military weapons include:
- Military weapons are manufactured in conformity with technical standards and designs of legal producers and provided for the people's armed forces and other forces prescribed by this Law for conduction of their missions, including:
Firearms including handguns, rifles, submachine guns (SMG), light machine guns (LMG), anti-tank rifles and grenade launchers;
Light weapons including heavy machine guns (HMG), mortars, B-10 recoilless rifles, anti-aircraft guns and anti-tank missiles;
Heavy weapons, including fighter aircraft, armed helicopters, tanks, armored fighting vehicles, warships, submarines, field artillery, anti-aircraft artillery, missiles;
Bombs, mines, grenades, torpedoes, naval mines; ammunition used for the weapons specified in Point a, Clause 2, Article 3 of the Law on Management and use of Weapons, Explosives, and Combat Gears 2017;
- Weapons are manufactured not in conformity with technical standards and designs of legal producers, are capable of causing damage, causing harm to human life, and destroying material structures similar to weapons specified at Point a, Clause 2, Article 3 of the Law on Management and Use of Weapons, Explosives, and Combat Gears in 2017, must not be equipped for the people's armed forces and other forces specified in Article 18 of the Law on Management and use of Weapons, Explosives, and Combat Gears 2017 to perform their official duties.
Note:
- When performing organized tasks, the use of weapons, explosives, and tools to support the Mobile Police must follow the orders of the direct commander.
The person issuing the order must follow the provisions of the Law on the Management and Use of Weapons, Explosives, and Combat Gears, as well as relevant legal regulations in Vietnam, and accept responsibility for their decisions before the law and superiors.
- The use of professional technical means and equipment when performing the tasks of the Mobile Police according to the plan approved by the competent authority.
- The use of weapons, explosives, supporting tools, vehicles, and professional technical equipment by the Mobile Police in training and drills shall comply with the plan approved by the competent authority.
2. Principles for the use of military weapons by mobile police in Vietnam
When performing the task of ensuring social security, order and safety, the use of military weapons must comply with the following principles in Article 22 of the Law on Management and Use of Weapons, Explosives, and Combat Gears 2017:
- Decide on the use of military weapons based on the situation and the dangerous level of the acts committed by the subject;
- Use military weapons only when there are no other measures to stop the subject's behavior and after warning, the subject does not obey.
If the untimely use of military weapons will directly threaten the lives and health of law enforcement officers or other people, or may cause other particularly serious consequences, they shall be used immediately;
- Do not use military weapons when it is well known that the subjects are women, people with disabilities, children, or the elderly, unless these people use weapons or explosives to attack or fight back or threaten. the life and health of the official duty performer or another person;
- In all cases, the user of military weapons must limit the damage caused by the use of military weapons.
In addition, the person assigned to use military weapons is not responsible for damage when the use of military weapons has complied with the provisions of Clause 3, Article 22 of the Law on Management and use of Weapons, Explosives, and Combat Gears 2017;
In the case of using military weapons beyond the limits of legitimate defense, causing damage clearly beyond the requirements of an urgent situation, taking advantage of or abusing the use of military weapons to infringe on life, health, lawful rights and interests of agencies, organizations, and individuals shall be handled in accordance with the law in Vietnam.
