1. Cases of transferring in the Party in Vietnam

According to Section 6.3.1 of Regulation 24-QD/TW in 2021, cases of transferring in the Party include:

- If a Party member is ordered by a competent authority to move to a new unit, retire, take a leave of absence, quit his job, serve, or change his permanent residence, he must carry out procedures to change official party activities within 60 working days of the effective date of the decision.

- Party members who relocate official party activities outside the district, provincial (and equivalent) party committees, and district (and equivalent) party committees that have relocated party members are responsible for carrying out procedures for introducing party activity transfers.

When a member of the Party committee or grassroots cell under the provincial Party Committee (and equivalently) changes to official party activities, the organizing committee of the provincial Party Committee (and equivalent) shall carry out procedures for introducing the transfer of party activities.

- Within 30 working days from the date of introduction, party members must present a paper introducing party activities to the branch committee where they have moved to participate in party activities.

If the above time limit is exceeded, the party member or party organization that violates the law must report the specific reasons to the competent committee for consideration and handling according to regulations.

- When transferring official party activities to party members, the Party Committee where the party member is living and working must complete all procedures, seal the file, and hand it over to the party member for them to bring directly to the party organization to carry out the procedures for introducing and receiving party activities under the guidance of the Central Organization Committee.

- In case a party member is being inspected or examined or is considering and settling complaints and denunciations, he/she must not change to official party activities.

2. Cases of temporary transfer in the Party in Vietnam 

The cases of temporary transfer in the Party are specified in Section 6.3.2 of Regulation 24-QD/TW in 2021, specifically as follows:

- When a party member changes his/her place of residence or working place within 3 months to less than 1 year; when sent to study at domestic training institutions from 3 months to 2 years, then back to the old unit, they must carry out procedures for introducing temporary party activities from the party committee or cell where the party members are officially living to the new party committee or cell where they work, study, or reside. Special cases shall be prescribed by the Secretariat.

Temporary party members have the following duties and powers:

+ In official living places, he/she shall fully perform his/her duties and rights as prescribed in Articles 2 and 3 of the Party's Charter; in a place of temporary living, except for the right to vote, to stand for election, and to vote.

+ If it is necessary to extend the duration of temporary party activities, a party member must report to the party committee where the party member is temporarily living to apply for an extension, and at the same time report to the party organization where the party member is officially living.

- Party members living in the temporary party shall not be counted in the party number of the party committee in the place of temporary living, but in the party number of the party committee in the place of official living; pay party fees at the branch where the party is temporarily living.

The level of members when temporarily moving to live will still be members of the official place of living.

- If there are 3 or more official party members who move to temporary party activities to attend classes, follow courses at a training institution, or go on a secondment in a unit under the grassroots unit, the party committee where the party is received shall issue a decision to establish a temporary living cell and appoint the branch committee, secretary, and deputy secretary of that branch.

The task of the temporary living cell is to lead the party members in the branch to implement resolutions of the superior party committee, manage party members, collect and pay party fees, and perform a number of specific tasks assigned by the superior party committee. 

3. Cases of transferring abroad in Vietnam

The management and transfer of party activities and the organization of party activities for party members abroad shall comply with the regulations of the Secretariat and a number of provisions in Section 6.3.3 of Regulation 24-QD/TW in 2021:

- A reserve party member who lives alone abroad, upon the end of the probationary period, must make a self-criticism on his/her membership in the party and the performance of assigned tasks during their individual activities; The Party Committee levels directly managing party members abroad shall base themselves on the comments and assessments of the party committees where they go and the party members' reviews to consider and recognize official party members.

- For areas outside the country with special circumstances, where there are not enough 3 official party members to set up a cell, a reserve cell can be established (including 3 or more party members, including official and reserve members), and the superior party committee shall appoint the party secretary.

- Functions and tasks of various types of cell branches and the tasks of party members abroad shall comply with the regulations of the Secretariat and the guidance of the Central Organization Committee.

4. Other cases of transferring in the Party in Vietnam

- Transferring when the Party cells are transferring, establishing, splitting, or merging.

When the competent authority decides to transfer, establish a new, split, or merge a party cell or party from one party committee to another inside or outside the provincial party committee (and equivalent), the immediate superior level of the party committee where the transferred party cell is located shall have to carry out the procedures for transferring the organization and transferring the collective party activities to the party members; The immediate superior level of the Party Committee where the branch or party cell is transferred is responsible for carrying out procedures for receiving party organizations and activities for its members.

- Changing party activities when the party organization is disbanded or dissolved

After the competent party committee decides to disband or dissolve a cell or party committee, within 30 working days, the immediate superior committee of that party organization shall revoke the dossier, seal it, and carry out procedures for transferring party activities to the party members.
