Environmental registration in Vietnam means that the project owner, production, business and service establishments register with the state management agency contents related to waste discharge and environmental protection measures of investment projects, production, business and service establishments. 1. Subjects for environmental registration in Vietnam
Subjects for environmental registration include:
- Investment projects that generate wastes that are not subject to environmental permits;
- Production, business and service establishments operating in Vietnam before January 1, 2022 that generate wastes are not subject to environmental permits.
2. Subjects exempt from environmental registration in Vietnam
Subjects in section (1) who are exempt from environmental registration include:
- Investment projects and establishments under state secrets on national defense and security;
- Investment projects in Vietnam when going into operation and production, business and service establishments do not generate waste or only domestic solid waste of less than 300 kg/day is managed in accordance with the regulations of local authorities; or waste water of less than 05 m3/day, waste gas of less than 50 m3/hour is treated by on-site treatment equipment or managed in accordance with the regulations of local authorities.
- List of investment projects and establishments exempt from environmental registration specified in Appendix XVI issued together with Decree 08/2022/ND-CP.
3. Procedures for environmental registration in Vietnam
3.1. Place of filing the environmental registration dossier
The subjects in section (1) send the environmental registration dossier to the commune People's Committee of the place where the investment project is located in Vietnam.
For investment projects, establishments in localities with 02 administrative units at commune level or higher, the owners of investment projects and establishments may choose commune-level People's Committees for environmental registration.
3.2. Ways to register the environment in Vietnam
Subjects can submit environmental registrations through the following forms:
- Direct;
- By post in Vietnam;
- Online version through the online public service system.
3.3. Environmental registration dossier in Vietnam
Environmental registration dossiers include:
- Environmental registration documents of project owners, establishments according to the form;
- A copy of the Decision approving the appraisal results of the environmental impact assessment report of the investment project or establishment in Vietnam (if any).
