1. What is professional sports club?

According to Clauses 1 and 2, Article 49 of the Law on Physical Training and Sports 2006 (amended in 2018), professional sports club is an enterprise that trains and coaches athletes and holds professional sports competitions. Professional sports clubs are members of national sports federations.

Professional sports clubs shall abide by regulations of national sports federations and international sports federations when they participate in professional sports competitions held by national sports federations or international sports federations.

2. Sports business requirements applied to professional sports clubs in Vietnam

Specifically, in Clause 1, Article 50 of the Law on Physical Training and Sports 2006 (amended in 2018), sports business requirements applied to professional sports clubs:

- Their officials and employees are qualified for professional sports;

- There are professional athletes and coaches;

* Professional athletes

Professional athletes must meet the following conditions:

+ Having an employment contract with a professional sports club.

+ Recognized by the national sports federation as a professional athlete. In case foreign athletes participate in professional sports competitions in Vietnam, they must have an international transfer certificate and a work permit in accordance with the labor law.

* Professional coaches

Professional trainers must meet one of the following conditions:

+ Having a university degree in physical training and sports with a major relevant to professional sports activities and completing the professional coach training program of the national sports federation.

+ Having a professional coach license issued by a continental or world sports federation of professional sports.

+ Having a foreign professional coach's license recognized by the continental or world sports federation of professional sports.

- Having facilities and equipment suitable for professional sports activities.

Facilities and equipment for professional sports training and competition must ensure national technical regulations, Vietnamese standards or international standards and conform to regulations of international professional sports organizations.

In addition, professional sports clubs need to have medical staff as required in Article 11 of Decree 36/2019/ND-CP, specifically as follows:

Regular medical staff during professional sports training and competitions or medical staff of medical facilities contracted by the professional sports club to provide first aid and first aid to participants in activities professional sports in case it is necessary to have a professional qualification from a medical college or higher.

3. Tasks and powers of professional sports clubs in Vietnam

Tasks and powers of professional sports clubs in Vietnam include:

- To participate in professional sports tournaments organized by national sports federations or international sports federations.

- To train professional sports athletes.

- To discover, select and foster sports talents.

- To sign labor contracts with professional athletes and professional coaches.

- To ensure material foundations, equipment and devices for sports training and competition.

- To ensure financial sources for their operation.

- To carry out production, business and service activities according to law.

- To be entitled to preferential policies on the use of material foundations, equipment and devices managed by the State.

- To enjoy conditions created by the State to increase their lawful revenues.

- To receive and use donations and contributions of domestic as well as foreign organizations and individuals.
