Some New Points of the Law Amending and Supplementing a Number of Articles of the Law on Emulation and Commendation of 2013

On November 16, 2013, during the 6th session of the 13th National Assembly, the Law on Amendments and Supplements to Certain Articles of the Law on Emulation and Commendation was passed. This law shall come into effect as of June 1, 2014. Compared to the Law on Emulation and Commendation of 2003 (amended and supplemented in 2005), the Law on Amendments and Supplements to Certain Articles of the Law on Emulation and Commendation of 2013 stipulates more specific standards for commendation to meet the requirements of renewing the work of emulation and commendation in the current period.

Out of 103 articles of the current Law on Emulation and Commendation, the amended and supplemented law spans from Chapter I to Chapter VI, comprising 47 articles and adding Article 91a. It also amends the names of Chapter IV and Chapter V to fully encompass the adjusted contents of these chapters. The amendments focus on revising and enhancing the standards system for emulation titles and forms of commendation to ensure stricter criteria. They avoid using emulation titles as the basis for commendation assessment to prevent the accumulation of achievements in commendation. Specific standards are set for commendation forms such as medals, certificates of merit, and certificates of recognition for farmers, workers, and direct laborers. Additionally, Article 91a is added regarding the Central Emulation and Commendation Council and the emulation and commendation councils at all levels. Besides, the law also revises and supplements some contents related to general provisions, principles of commendation, authority to issue emulation titles, commendation, and procedures for awarding emulation titles and commendation forms, specifically:

Regarding general principles: It is stipulated that collective and individual commendation for achievements should be based on "merits and achieved results," overcoming the situation of commendation in sequence—only considering higher forms after lower ones are awarded. The commendation targets are expanded, especially for farmers, citizens, etc. It specifies that "multiple forms should not be awarded for one achievement," thereby avoiding duplicate commendations. The principle of "Ensuring gender equality in emulation and commendation" is supplemented to guarantee equal rights and obligations for men and women as per the spirit of the Law on Gender Equality.

The law has resolved the issues encountered in applying the "initiative" standards during the commendation process by supplementing and listing the forms of initiatives: "Initiatives are technical solutions, management solutions, operational procedures, or technical advancement applications that increase labor productivity, improve work efficiency recognized by the institution or from scientific research topics that have been accepted and applied, or ingenious, creative actions in combat or supporting combat, excellently completing tasks recognized by the unit." This has facilitated the consideration of emulation soldier titles at various levels.

Regarding commendation standards: Previously, commendation standards used emulation titles as the basis for commendation forms; for instance, an individual achieving the title of Basic-level Emulation Soldier for two consecutive years was considered for the Chairman of the Provincial People's Committee's Certificate of Merit or a Certificate of Merit from ministries and central authorities. Currently, commendation forms such as Certificates of Merit and various medals do not specify emulation title standards. This new point opens up commendation for small collectives, and those directly working, studying, laboring, fighting like farmers, workers... in the spirit of Directive 39-CT/TW dated May 21, 2004, of the Politburo "On continuing to innovate and boost the patriotism emulation movement, discovering, fostering, summarizing, and broadly replicating exemplary models." Generally, the commendation standards for various medals demand higher achievements. Additional particularly deserving individuals can be awarded the Golden Star Medal, the highest honor from the Communist Party and our State for foreign heads of state with significant contributions to Vietnam. The timeframe for reconsidering State honorary titles such as: the titles “People’s Doctor,” “Outstanding Doctor,” the titles “People’s Artist,” “Outstanding Artist,” the title “Outstanding Craftsman” is increased. The title “Hero of Labor” is reconsidered every 5 years; the title “National Emulation Soldiers” is awarded to the most outstanding individuals from ministries and central authorities, provinces, and central unions.

Furthermore, the new law includes some new points compared to previous ones regarding emulation titles and commendation forms. It adds the title of Emulation Flag for Military Zones, Military Services, Corps, Arms, General Departments, and equivalents under the Ministry of National Defense and Ministry of Public Security. Regarding the “Commemorative Medal” form, provinces and centrally-run cities can grant badges to individuals who significantly contribute to the development of the province or city. It adds “Households” as commendation targets. Regarding the commendation authority: The Chairman of the Communal People’s Committee can recognize the “Advanced Labor” title, the Chairman of the Cooperative can recognize the “Advanced Labor” title, or “Basic-level Emulation Soldier” title. It specifically stipulates the responsibility of heads of agencies and organizations regarding commendation tasks such as deciding on commendations, recommending commendations, and the responsibility of identifying and cultivating exemplary models such as workers, farmers, laborers from various economic sectors for commendation or recommending them for higher-level commendation...

The new law supplements the functions, tasks, and organization of the Central Emulation and Commendation Council as a basis to develop the functions, tasks, and organization of emulation and commendation councils at all levels.

It can be said that the newly issued law amending and supplementing a number of articles of the Law on Emulation and Commendation generalizes the emulation, and commendation relationships from reality, in compliance with the existing legal system, and meets the reform requirements of emulation, and commendation work according to the current Party guidelines.
